Tenant/Leasing Question

Anyone out there familar with Tenant/Landlord Laws? I have a question for you.

If a friend of mine decided to rent a townhouse in another town that they can stay in while on frequent business trips rather than staying in hotels and let me live there as long as I paid the utilities and kept the place nice while he wasn't there, would I have to be named on the lease?

I was speaking with an agent, and she claimed I would need to be named on the lease if I was living there, and I would have to meet the minimum salary requirements, have a credit/employee check done on me, etc. Seems she was just trying to scare me away so I wouldn't bother her with tedious questions. But just because I'm the current tenant, and not paying any rent doesn't mean I have to sign the lease with my friend right? He could rent the house out, and if he wanted to let me live there, he could without getting me involved in the legalistic signing of a lease.

Thanks in advance

Check his lease agreement. There may be specific language inhibiting his ability to "sub-rent" to someone else without the owner's knowledge. This has to do with liability, occupancy rights issues.
If he defaults on the lease and skips, and you are habitating there, ie.paying the utilities, etc., this may be enough to encumber the owner from re-claiming the property immeadiately and then, perhaps, from coming after you for damages.
Read his lease.
Call city/county/state Tenant Rights depts. or organizations for details for FLA.
You may have rights as a domestic partner, but a roommate, even for free, because you are paying utilities, clouds the issue.
Good luck.....
