But telemarketers say 27 existing state do-not-call lists and a voluntary national list run by the Direct Marketing Association trade group should provide consumers enough protection.

In the suit, the DMA and four telemarketing firms said the FTC's effort would violate free-speech laws and discriminate against an industry that provides millions of jobs.

"The FTC is singling out this form of advertising now, what will be next?" said DMA President Robert Weintzen in a prepared statement.


Cry me a river. Freedom of speech doesn't supplant my right to be left the hell alone while trying to eat dinner with my family.

How does that violate free speech?

They're not expressing a point of view, they're selling a product. Last time I checked, consumers had the right to not be accosted inside their homes.

How is a DO NOT CALL list any different from putting a "No Soliciting" sign on your front door? I don't think that "No Soliciting" signs have been ruled unconsitutional.

Oh, and this reminds me...my telemarketer blocker that I pay $2 a month for is the best $2 a month spent EVER!

We have the freedom of speech - that is true. However, the Supreme Court has ruled many times that there is a time and place for all our freedoms. You are NOT free to shout "Fire!" in a crowded building (causing a stampeed that kills several people). But you can shout "Fire!" anywhere else - you just were in the wrong place. Thus the telemarketers are perfectly free to make their pitches - just not in my own home. Limiting the place does not remove the freedom.

Often it's 4 or 5 phone calls per evening....each made by a determined (obnoxious) telemarketer that takes 10 min to get off the damn phone. I have better things to do than deal with those f*cksticks every evening. I've been diligent about telling each one to put me on the do-not-call list and keeping a log of this. First bastard that calls me twice is gonna get sued for at least 500 beans. :D
What I hate most is when I tell a telemarketer that I don't want their product and I want to be off their list and hang up - and then that same person calls me back 5 times in the next 10 minutes to complain that I wasn't very nice when I made those statements. What did I just ask them? Yep I asked not to be called! So why are they calling me back on purpose? I've had that happen more times than I can count. I even one day got so many calls from the same lady (after asking her not to call me ever again) that I just started picking the phone up and hanging it up immediately. I eventually got so tired that I let it ring and the answering machine recorded: "Don't you hang up on me, it is my right to telemarket and I can keep calling you legally as long as I want".

NuclearFusi0n: it isn't "just a phone call". It is illegal harassment.

I hang up on them. If they call back, I shout bad things to them and hang up again. My dad interrupts them, says no thanks, then hangs up on them.

I like my method better.

Dullard: you have to tell them to place you on their do-not-call list (pretty much those exact words). They think it's terribly funny when you tell them to take you off their list, since that's not how it actually works. ;)

Like I said: keep a list of who you tell this to and when you do. If they call you back after you make this request, you can tag them for $500 per call under the Telephone Consumer Protection Act of 1991.

Sadly enough i used to be in telemarketing back in high school. It was hell on earth and i would mute the people i did not like to listen to. I regret having that job, but it put perspective as to me wanting to get a college degree and not be in these people's shoes for the rest of my life. Don't give most of these people crap. They are just trying to get by. NOW some are dicks, and i am sorry for those that get them, and by all means, treat them like dicks, but the majority are not, so just be semi poilte, and SAY THE RIGHT SH!T. . .for example, don't yell and hang up. Say to be removed from list, and all affiliated lists. Ask for a mster removeal number to call to get removed from all lists to and from the person calling. Put yourself on the do not call list that is offered in your state. That will get rid of most people.

Some of you are missing the point. The Do Not Call list is an optional list that you can put yourself on. The biggest flaw in the telemarketers drive is that we do have the freedom of speech, we also have the freedom of shutting our ears. We only have to listen to what we want to.

i think that the telemarketers should have to put up with our sh-t no matter how much we act like assholes. they call us in OUR HOMES, we can say whatever the f-ck we want.

I hate telemarketers as much as anyone, but it is their right to sue if they think their rights are being infringed upon. Hopefully, they won't have much of a legal arguement. I can't believe that the FTC hasn't antipicated this.

I see where you are coming from, but telemarketers make their living making unsolicited<sp?> phone calls to peoples' homes. That's not the best way to start out on someone's good side. ;)

Me, I try to make it simple on everyone. I just hang up. I don't waste their time and they don't waste mine.

The only telemarketing call I've accepted was from my local cable company, and the only reason I didn't hang-up is 'cause when she introduced herself I thought there might be a problem w/my account or something. But she went onto say I could get 100 channels of Digicable for $7.95 a month for 6 months no strings attached and I was like "fck yeah." But now I'm rambling...

This lawsuit is a travesty. It should be my right to opt out of invasive marketing that borders on harassment. They have free speech, they can say whatever they like, but that doesn't obligate me to listen. Obviously the people are behind the FTC on this, marketing has gone too far and giving people the OPTION to voluntarily remove themselves from this annoyance is not in the least unfair.
