DAYTONA BEACH, Fla. -- One of the teenagers responsible for beating a Holly Hill homeless man to death asked a judge to reduce his 22-year prison sentence Monday. Warren Messner and three other teens pled guilty to killing the man because they were bored, but Messner said prison is too hard.

Messner is a big boy. He was 15 at the time he was brought into the woods to see the homeless man his friends had been beating. Even at that young age, he outweighed the victim, Michael Roberts, by 200 pounds when he jumped on his chest, crushing his ribcage. Roberts died.

"Did you feel bad when you are doing it?" Messner was asked during questioning.

"Not really, no," he replied.

He didn't feel bad then, but he does now. He has been in juvenile detention for eight months, locked in a small cell and occasionally allowed to go to class.

Messner and his attorney said he has already learned his lesson and is ready to go home to help others.

"I want to be an inspirational speaker for troubled teens," he said Monday.

Messner got the lightest sentence of the four boys. Teens Jeffrey Spurgeon, Justin Stearns and Christopher Scamahorn got 27 to 35 years. They all cut plea deals to avoid life in prison.

The state attorney said that's as much leniency as they should get and the judge agreed.

"I can't think of some reason to change the sentence. I'm going to deny the motion," said the Hon. Joseph Will.

Messner's parents broke down at the denial. His mother said it's unfair, that her son fell in with a bad crowd and prison is killing him.

"He's not getting the mental health, the schooling. He's not getting anything, anything but locked in a cell all day long," Lori Messner said.

The judge and the state both argued that being deprived services and being locked away is precisely the point of prison. Warren Messner will spend the next 22 years in prison without the chance for parole.

"Did you feel bad when you are doing it?" Messner was asked during questioning.
"Not really, no," he replied.


Do we feel bad about you getting to rot in jail?? I think you just answered the question for us.

He needs to at least fake remorse if he wants some sympathy. Crimes have consequences and he should have thought about that before aiding in the murder of another human being. He still has a chance and will get out someday, the man he helped to murder is gone forever.

Let him rot. He wants to get out of jail because he doesn't like it, not because he feels bad about the crime? LOL isn't that one of the points of jail, to be punished for your actions?

He'd make a great inspiraitonal speaker - you shouldn't not commit a crime beacuse it hurts someone else, but you should avoid it because jail is tough. Yes, he truly is a real humanitarian.

He can complain about not having enough in jail, but it is better than what his victim and his family has :thumbsdown:

what is the point of someone who can do something like that to another human being alive?

Really, whats the point? To prove we are better than him? I ask, would he care or even acknowledge that reason exists?

I think jail is hard for him, being a sweetcheeks 15 year old, hearing the other inmates chant, "Fish, fish, fish" every night. The little bitch.

I vote we change his sentance, to life in prison.
Make sure this scumbag never sees the outside of a prison ever again.

Then she should offer to take his place since she didn't do enough to keep him out of that crowd?

Anyhow.. these cases are sad for all parties involved.. but they all can make good come out of it somehow

She can help other children so they don't become troublemakers or she can help parents spot trouble in their childrens friends or help give kids more activities to do after school etc. etc..

He can READ BOOKS and become wise and educated all at the expense of the victim and the taxpayers and use his knowledge to help others.. etc etc

Victim society rears its ugly head again. Your dumb effing kid kills somebody and he is the victim? Maybe if you were a better parent and taught your kid consequences he wouldnt be out killing homeless people because he is "bored".

That guy is a useless waste of oxygen, and is of no value to society. He should be let out because jail is too hard? Pfft. Only if we can get some 300lb guy to jump on his ribcage.

They admitted to beating Roberts, returning to the scene three times over a three-day period, kicking and punching him, beating him with sticks and rocks, and jumping on him, continuing to do so even though Roberts begged them to stop.

Right, blame the parents. You do realize that parents can try to do a terrific job and a kid is just fvcked up anyway, right? It happens.

Instead of taking the easy way out and sticking him in jail, where he will actually get worse, my suggestion would be some rehab, some psycho analysis, something to make him a better person instead. We're spending the money anyway keeping him locked up. I mean, obviously this kid aint right in the head if he did what he did. What kind of parenting resulted in this?

Most people here just want to put a bullet in this kid's head. So, what, you end up with two people dead. I think it's better if we just stick with the one dead, can't change that, and see if we can fix the other one before winds up dead as well.

The United States is a vastly Christian country. Some 80% of the populace considers themselves to be one denomination of Christian or another. I, myself, am an atheist. Chiefly because of the disgusting hypocrisy exhibited by so-called Christians. Those of you that suggest putting a bullet into this child's head need to stop calling yourselves "Christian" please. Do society a favor and let them know that while you call yourself a Christian, all of the morals and beliefs of that religion hold no credence over your everyday life.

Institutionalize the kid. Prison will only make him a prisoner. He'll get no rehabilitation there.
