Teen Charged After Attack Caught On Tape

Posted: 3:00 pm EDT May 26, 2009Updated: 5:35 pm EDT May 26, 2009
DOUGLAS COUNTY, Ga. -- One teen beat another at school and the victim said he was so scared about retaliation he didn't tell anyone about it for months. Now, a teen is facing felony charges in connection with the attack that was caught on tape.

A 15-year-old has been charged with two felonies in connection with the beating of a student inside Lithia Springs High School. The beating happened in December 2008 and was caught on cell phone video.

The video apparently shows one 15-year-old kicking and stomping the head of another 15-year-old in a school hallway.

Channel 2 Action News reporter Justin Farmer met with the victim, Zach Cielo, to talk to him about the incident.

Cielo said he was so worried about retaliation, he didn't tell anyone about what happened to him -- including school officials or his mother -- until now.

"I didn't know what was going to happen to me," said Zach Cielo. "(He) could've put a clot in my brain...I could've died. But I lived through it."

But Cielo's mother said she has seen enough.

"I have made (the) final decision that I am taking them out of the school and I'm taking them out of the country," said Lulu Cielo, Zach's mother.

Going against her children's wishes, Lulu Cielo said she has decided to send Zach and his 12-year-old sister to her native Philippines to go to private Catholic school.

"She's doing it for the better of me and the family," said Zach Cielo. "I understand where she's coming from."

Lithia Springs High School officials are being supportive of the victim's family and plans to expel the accused.

The accused is a juvenile and his name will not be released.

"He was one step away from an aggravated battery, which would have been if he had broken his spine, or actually killed him. You saw the kick to the head," said Chief Deputy Stan Copeland with the Douglas County Sheriff's Office.

The suspect is in his mother's custody. The Douglas County Sheriff's Department said they are hoping prosecutors will come down hard on him to show others beatings won't be tolerated.

I know where he's coming from; same thing pretty much happened to me when I was about 17.

Police got involved and forced me to go to court, though.

It looked like that kid was trying to kill him and he only gets charged with 2 little felonies??? He stomped on the little kids head multiple times and then jumped on his head with both feet.

Perhaps it's just me but that doesn't even seem close to attempted murder. Just an ass kicking.

You jump on somebody like that it is attempted murder. That's how you kill an animal - you stomp on their head. Just like what should be done to the perp. A few head stomps and he's dead. In his last moments as his brain shuts down he'll be able to reflect on his actions and feel the pain of knowing he will soon die. That's how you kill the animal. It's quick, but not so quick that he won't feel his own soul scream. That scream as his eyes roll back into his head. A warning to all those that wish to repeat this action (like those cheering him on and laughing).

And invite everybody he knows so they too can watch what happens to animals like this.

Wow that's brutal. That should be a charge for attempted murder right there. The kid will probably have problems for the rest of his life, I'm sure that did some serious brain damage.

And I find it pretty sad that they would have only put the battery charges if the spine would have been broken or if he would of died. Why wait for the worse? The fact that it could of happened should be enough for the charge to be laid.

I don't think it was attempted murder, because I don't think he was trying to kill the kid.

I do think he could have killed him though. He put the kid's life at risk. I don't know what the legal term for that would be, but I hope that kid gets an appropriate punishment.

At least something like aggravated assault but 2 little felonies which mean nothing to him since he's a kid.

How callous of the article to say so bluntly that the assailant won the fight. :p

Seriously though. try his ass as an adult and don't look back.

You jump on somebody's head or chest, you are trying to kill them. This again is how you kill an animal. Then again the kid was only doing what he was taught (sp?). Learned behavior. Kill him (attempted murderer) now and make sure those that would repeat his actions learn their lesson.

His actions, egged on by the other animals, means you treat it like an animal.

You guys must have lived sheltered lives if you think that was attempted murder. That's just a normal everyday schoolyard fight. Sure, the kid should be expelled, but only because he got caught.

Does it really matter what we think? He was charged by the state, you know, the people that know the law better than you? It doesnt fucking matter what happens all the time in your school....

Please... a kick and stomp to the head of a person is not a average fight in any means short of living in a prison and the kid should be tried as a adult for that kind of crap.

I'm sorry. I didn't know you were so hood.

Only times that I saw someone trying to stomp on someone's head was when they were trying to kill them. Not every school fight has everyone stomping on each other's heads.

That's your opinion. You are inferring intent. We don't know what his intent was. You can state your opinion as a fact, but that doesn't change the fact that it's an opinion and nothing more. I stated my opinion as an opinion, and I haven't changed my opinion despite having read yours twice. You wouldn't change your opinion if Jesus came to you and told you to do it, so we are an at impasse.

At least the young man and his mother got the closure they needed, thanks to the surfacing of the video and the arrest of the attacker. The case could've gone cold for about a year.
