Tape backup question.

I just purchased a seagate 20GB tape backup system with Tapeware software. I noticed that each time a full backup of the system is done, a small number of files (objects) are not backed up properly. I assume this is because these files are in use while the backup is running. Is this normal? Also, if my hard drive were to crash completely and need to be replaced, is it possible to copy the contents from the tape to the new hard drive without first installing the operating system? If the OS has to be installed first, how exactly does a full restore work? Does it replace the entire OS with what is on tape and then require a reboot? What would happen if the backup tape contained Windows 98 and I did a full restore to a system running Windows ME?
