Taco Bell fighting the owner of the trademark in 49 states.

"The fast food chain fittingly picked a Tuesday (May 16) to file a petition with the US Patent and Trademark Office’s (USPTO) Trademark Trial and Appeal Board to cancel two trademarks on the taco-promoting slogans. The California-based company said it “seeks no damages or trademark rights.” Instead, it’s seeking “common sense for usage of a common term.”

Rival chain Taco John’s has owned the trademark in 49 states for the past 34 years. Other restaurants and companies must seek permission to use “Taco Tuesday” in branding and advertising, or risk legal action. A small business called Gregory’s owns the registration in New Jersey. Taco Bell has filed a petition to cancel Gregory’s registration in that one state, too."

^^^ I came upon this critically important piece of news through the news aggregation site Numlock News. Like that site title? Then you might just be a member of Anandtech.com!

Anywho, what prompted me to alert all you fine fellows (and the one possible female amongst us) was the following phrase in Numlock's announcement:

"Taco Bell, with its 15,638 eateries that sell food that occasionally resembles tacos, is hoping to free the phrase up from Taco John’s, which has around 400 locations."

Because, as so many of us tragically know, after consuming Taco Bell, you do need to get to your very own "taco john."

Taco Tuesday for me will always be associated with Taco John's. Wish we had one here.
 
I saw this two days ago (thank god I’m not the only one to dive into obscure regions of the internet) and I side with the originators. It was a marketing ploy that worked and clearly caught on.
 
Ha, true. We had them where I grew up in Wisconsin. Been a long time, but I remember liking their food better than Taco Bell back in the day.
 
Wtf is taco Johns? That sounds whiter than Taco Bell!

I don’t remember the specifics but I thought I first encountered the phrase “taco Tuesday” from a movie or TV show.
Taco John's was founded in Cheyenne, WY so that should clue one in. When Taco John's first opened in my fair city, all they served was reheated frozen entrees that came in foil containers. The drive through only restaurant was located in a former Fotomat. The food was still better than Taco Bell.

Pseudo chedder cheese and not far off on the hot sauce. Taco Johns is ok, my favorite is Taco Tico but those are about gone now. Also can't forget Taco Grande and Taco Via.

So many midwest based taco chains.

Taco John's is slightly higher quality than Taco Bell IMO, but it's also more expensive (and without the hot sauce, a little more bland). They do have better hot sauce, and their fried potato product whips the hell out of Taco Bell's. That said, as someone who used to eat there with some regularity, I didn't know they had a "taco Tuesday" thing going on.
I'm on board for this removal of restriction on the term "Taco Tuesday" though.
 
Taco Bell is just pissed that they didn't trademark Taco Tuesday first. I have zero doubt that if they had, they'd be defending their trademark with all available options.
 
well Taco John should charge Taco Bell extra for using Taco Tuesday. You know, to cover the lawyer fees.
