Well, I agree with you on advertising unlimited but not really giving you truly unlimited with no restrictions. They should be advertising like unlimited browsing/music/video, maybe it'll be clearer what you can do on your phone(browser web, listen to music, watch video, no torrenting or tethering to the extreme.. Just 'fair use' of your mobile connection)

Even so, their original tos prevents torrenting. They're only enforcing their tos right now. (Though few people read TOS)...

This is the problem with the world. People claim ignorance and try to use that as an excuse.

You are responsible to read and understand what you are signing up for. This is why people are shocked when they find out their loan has big interest rates, they didn't read it before signing.

Exaxtly. Data is data. Dont sell all you can eat buffet if you cant cook the food fast enough.

this

if they want their plan to be unlimited then call it unlimited

if they want their plan to have limitations or usage application prohibition then call it what it is. unlimited*

*if you go on facebook or look up cat pictures.

I simply will never understand why a customer should be penalized for using a service they paid for as advertised.

It would appear they are not using the service as advertised if they are violating the TOS. Seems pretty straight forward to me.

There is no such thing as unlimited anything, ever. T-mobile has identified a very small percentage (I have heard it is 20 users so far) of people who are abusing their data. They plan on throttling these individuals. These people are actually not using their phone for data and are working around the hotspot limitations which are not unlimited.

It annoys me because it's a fear of where they will draw the line.

Those Verizon unlimited users who use it as their home internet, and gobble up 50GB+ every month? Yeah, fuck em, throttle their asses.
Those of us who may use 5GB-10GB on some months, yet maybe even only 2 or 3GB the other months? I sure as hell don't want to see my data throttled.

I saw a figure that stated the average bandwidth usage for those in the top 5% would be pegged at a little under 5GB. So, while there are many 10GB+, 20GB+ data users, they might be the top 1%. The next few percent are taken up by under 10, perhaps even under 4GB.

Those users who use 5, 6, 7GBs on what is labeled unlimited, should hardly be punished for it. Those who use 20+, throttle for sure! (**IF NECESSARY** for congestion purposes, at that local cell site.)
I'll understand throttling 10GB regular users, if it absolutely has to be that way. I'd rather it not.

So... anyone who uses more than you is an abuser and should be throttled, while your usage is just right.

I'm pretty sure there are a small percentage of people who abuse it to download illegal movies etc. daily. This is breaking their ToS, so I'm ok with them throttling those jackasses. I've done 30GB but this was with spotify/youtube/etc. Glad they're doing this with those jackasses.

LOL, people. "Those guys and their evil 30GB are bad, but my 30GB is legit"

That's not what was said at all.

Illegal downloading and circumventing the hotspot usage limit is against the TOS. Apparently this is what they are targeting.

the link you posted says this

Sievert’s comments follow a leaked internal memo that the company is distributing to field staff to explain the effort.
That memo, Sievert said, was misinterpreted by some to mean some sort of broad throttling of heavy users. He stressed that for customers paying for totally unlimited service on their phone, T-Mobile means unlimited.
“There’s no limit on data,” Sievert said. “People can use it as much as they want on their smartphone

T-Mobile, however, does prohibit the use of peer-to-peer file services as well as limit the amount of data customers can use when tethering their phone to a computer. Sievert said T-Mobile may take action if customers are finding ways to circumvent such limits or otherwise violating the company’s terms of service.

the first says that unlimited data is unlimited data.

but the second he turns it around and says that all data is not equal.

when in fact that's completely false, data is data.

No...geeze. They limit your tethering. They do not want you using this for your computer internet connection 24/7 that is pretty clear. They sell data plans specifically for your computer... Of course they want you to sign up for that.

Some of you are reading too much into it when it is plain as day.

what is the difference? the data on your computer is the same data on your cellphone.

so wheres the distinction?

all data is equal all of it there is no difference between surfing facebook and streaming youtube compared to downloading a torrent on your computer.

I was going to switch to TMobile until I heard that they will limit tethering.

That is stupid because I pay a large fee and expect the unlimited data to be able to used any way I wish...

Tethering is part of the phone I don't understand why they say its considered different data usage.

99.999999% of torrent traffic is illegal.
Since we're talking about a US carrier, no one gives a crap.

again torrenting is 100 percent legal you know the act of torrenting not what is being torrented just the act.

so my claim still stands.

but thanks for whatever the hell you were trying to say.

Torrenting is legal, but if you're using a company's network, and their TOS says no torrenting, then it does become "illegal".

I don't understand why we consider mobile data more precious than wired data? Why shouldn't someone use mobile data the same as they would wired data?

If a mobile network can't handle "unlimited" data, then don't sell unlimited data.

because there's only one wire, and it's the EM spectrum

what they should do is sell unlimited BROWSING bandwidth and find some way to profile the data.
MetroPCS started something similar back before T-Mobile buyout, but basically it only counted media streaming against you.
Then they could meter how much they actually give you-- unlimited browsering, 10GB media or whatever

One thing though. Isn't it unlimited you pay for? And so unlimited you should get?

I understand it's like an All You Can Eat Pay One Price buffet and the dude stays all day and clears out the buffet trays, but shouldn't have T-Mobile addressed this before selling an unlimited plan? If this was already addressed than I apologize. I just skimmed a bit.

t-mobile advertised it as unlimited

but within the TOS(if you ever burrowed into the contract details) it says no torrenting

They sell you a plan that you will use your phone or tablet for. Not to run your home office or host torrents.

I've never noticed that in their TOS! They just say "Unlimited Data".....use....use....use. We're the best, we're the fastest, we're the most reliable, and did I mention, we have UNLIMITED DATA!!!!

BTW, They ALL lie! Despite their claims nothing is truly unlimited. It's typical big corporation bullshite! Bait and switch and out right lies!
