Sushi Chef salary reduced arbitrarily ? *UPDATE*

My GF is a Sushi Chef for a new resturaunt in town.

She was promised 9.00$ an hour through a verbal agreement with her direct manager. This occured on Dec 22.

Last night she was told that she would only be making 6.50$ an hour, due to thefact that Sushi Chef's receive a portion of the Wait Staff's tips.

But, the managers have known that they would be providing a tip pool to the Sushi Chefs when they offered the 9$/hour wage to my GF. But, last night only one Sushi Chef was on duty (the other called in sick), and he made a large amount in tips via the tip pool. This was the major reason given to my GF as to why her wage was to be reduced.

I find this to be rediculously unfair. Considering that Sushi Chefs do not hand out bills, and are not poised to collect large amounts of tips.

Should my GF demand a better explanation ?

Should my GF demand to be paid 9$ per hour for, at least, the work she has performed up until last night ?

Should my GF demand her originally agreed upon wage ?

**UPDATE**

My GF spoke with both managers at her resturaunt today. They told her;

"It is our mistake. We fvcked up and told you a salary that we now realize we cannot afford. We are sorry, but there is nothing we can do. We will pay you the original salary for your work so far, and your new salary from now on. We want you to stay, but we just cannot afford to pay you what we had originally agreed upon".

They also told her that another chef was leaving the resturaunt in 2 weeks, and at that time they may be able to raise my GF's salary back to, or close to, her original. No promises, of course.

So my GF doesn't know what to do, but I'm thinking she will probably wait out the 2 weeks and see what happens.

IMHO, she should put in her 2 weeks notice right away. No excuse for this level of unproffesionalism (sp?) from both her managers.

Honestly I think you're girlfriend should quit. This may be a harbinger of things to come.
 
Depends how badly she needs the job and whether the tips are really good or not. If it's in a nice area of town then she should be happy with the tips.
 
In my opinion, this is so highly unprofessional of her managers, that I would agree she should quit.

She is going to talk to the managers and see if they will honor their original agreement, and if not...she will resign.

you only need to get things in writing if required by the statute of frauds. this isn't one of them. so, yes, the $9.00/hr is a legally binding contract and she is owed that up until she was told she would be paid less.
 
Depends on how much she makes total, including tips. Also, if she is in need of the money. I would ask for the agreed on wage. $2.50/hr extra over the course of a year is a decent chunk of change.

How hard is it to be a sushi chef? Is there formal training? I've ate at great sushi places and blah places and bad places. How is the quality of the sushi affect by the sushi chef?

Last week they told her she would be making 9 bux an hour. Both her, and I , sat down and actually created an entirely new personal budget for her based on the salary.

It is simply, flat-out, WRONG to promise one wage and then change it based on information that was already in the manager's possesion.
 
I, personally, couldn't work for someone that I didn't respect or trust. How does she fell about that? Unless she gets this resolved, somehow, she might not enjoy working there.

Unless they follow certain criteria as described under UCC law, which all states but Louisiana use.
 
Today my GF is going in to speak with her manager. She spoke with him on the phone, and he tried to play the blame game by saying another manager had actually made the decision. My GF will have none of that. She will be demanding her originally agreed upon salary, or something equally comparable.

She has another Sushi Chef job waiting around the corner that has better hours and is closer to our house. She only wants to stay at this new resturaunt if they will pay her the originally agreed upon salary.

Her manager agreed to speak with her today about the subject, and actually confessed that he disagreed with the other managers decision, and that he was willing to do "whatever it takes" to keep my GF around.

I wish her luck, but I would take the other job as I have been in a similar situation before, stuck it out and I ended up leaving anyway. Any sushi chef should make more than $9 an hour as they could get someone really sick if they don't know what they are doing. And what is going to keep these guys from doing the same type of crap when she is up for a raise.

Interesting take on the Statute of Frauds, which theoretically supports your position. However, the oral agreement did not prevent her employer from firing her before she even starts. Thus, an oral agreement to pay $9 dollars an hour is largely meaningless when it can easily be vitiated by terminating her employment. Nevertheless, I agree that any time worked on the previously agreed upon wage of $9 per hour is enforceable.
