i need a modem...

but i don't get it. the title to your post seems misleading, wouldn't one have to commit fraud to get this modem for $39.99? if i am misunderstanding could someone please explain in more detail how this deal works?

u should always chk to see if the modem you're getting is compatible with your cable/dsl service before buying it. + there is no big advantage for getting a new modem. some modems are easier to hack/uncap than others, but if you're just going to use it normally, there is no noticable advantage in speed/latency/etc.

Even with the one rebate of $20.00 this is a good deal for a cable modem of this class. Paid $99.00 for my 4100 & was happy as hell.

I got this modem to day -

rang up @ 79.99

told the cashier i had a $25 off $75 coupon i left @ home - and i gave it to me

out the store w/ modem for 59.02 After tax w. a $20 rebate to send it

then wouldnt you know - my old toshiba modem starts working

poop - keep it or return it?

I don't think there's any difference in getting a new modem with regards to better performance. On the hacking/cap issue, there's quite a few documented cases about the cable companies actively persuing people for uncapping their modems. You might wanna think twice before going up that particular road.

Here's a horror story concerning Six hours! of uncapping leading to a lifetime ban.

The best way is to NOT DO IT. Cable companies have a way of tracing uncappers - and once you're banned, you don't get back on. If you're using 35MBps and the typical usage is 1.5MBps, they'll notice.
