Meh.

The specific contents of the drive is of no relevance to the situation.

Being in the computer repair business myself for ~15 years now, sometimes shit just happens.

I'm wondering if it naturally broke (due to a previous condition) while in BestBuy's possession or if they intentionally formatted it.

ultimately, you need to backup. but, I wonder if anyone ever successfully has taken a repair shop to court, and won, for killing an HDD...

Doesn't the customer have to sign a work order authorizing geek squad to work on their computer? If so, I bet the work order says that customer must back up all data prior to service and geek squad is not responsible for data loss. When i worked at compusa, this was listed in the terms and conditions during check in - that the customer signs. Customers are responsible for backing up their own data.

Edit: just read the stuff on the link and it looks like they have no signature proof from customer... hmm i'm not sure then

I think that's the point of the black guy avatar. To make it very apparent that the poster didn't even bother to change the avatar to anything else. It makes it very easy to spot the spammers as they almost always use the black guy avatar.

i have little sympathy for people who don't back up their shit, especially if it's important shit. there's tons of ways to back up and many are inexpensive or free.

He?d have better luck just complaining to best buy?s corporate office. On a side note, the Geek Squad handbook is interesting. Please make sure you check the computer for dust. It does also say that a phone call is to be made if hard drive failure is imminent. Of course, one would have to recognize the pending doom in order to make that call?

Oops.

You sign the Data Liability Waiver (It's on the back of the DRD / Data Backup form) saying that while in possession of Geek Squad they are not liable if their repairs cause data loss.

Yeah, this guy is simply screwed. If he didn't have the knowledge to repair his own computer, then it was his responsibility to use a backup solution. If it's that important to him a $100 external drive backup would have been worthwhile, especially in light of Geeksquad's ass-rape prices.

Here's the real question, where they really pictures of his recently deceased parents, or was his kiddie pr0n collection lost?

Guy should learn how to burn a CD.

Everyone knows computer parts can stop working sometimes. Nothing anyone can do about it. If the drive physically crashed and died, it's not BB's fault. Of course if it didn't and they formatted it and wiped it to reinstall something, then it is definitely their fault.

But when people don't make backups it's their fault.
