I am sure there is a loophole to get it waived. Maybe tell them the old one is broken and you had to buy a new one.

Not at all. Mainly it depends on the mood the CSR you talk to is in. No contract required.

Be sure to get the serial # (or whatever the # is called)..if it's a reported stolen phone Sprint won't activate it. So get the number and verify with Sprint that it can be activated.
