stupid landlord.....

I finally found a great aprtment...however, after I got approved and everything, I was about to pick up teh keys and I get a phone call. It was the realtor telling me I lost the apartment because the current person living there said she wanted to stay. All this happened after I was accepted and the keys were about to be given to me. What io want to know is, if the apartment was not on the dam market, why would you try to rent it out? How can you rent somethign that is not really there? I gave my official move out day to my landlord and now I have to be out in 30 days...WTF!

Wow... that sucks!

Can you talk to your current landlord and retract your move notice?

Detrimental Reliance.

There are all sorts of damages you can claim if you signed a lease at the new place and then they backed out.

That is teh only legal thing that sucks fo rme......I was about to sign the dam lease then the girl comes down tells them she wants to stay and bam....the lease is taken away from me...the realtor looses his fee....and I loose an apartment...eveyone is mad expcept the girl who stays in the apartment....it happened all so fast. I should have just took the dam lease back and scribbled my dam name!

The landlord said teh girl had 30 days at noon to say if she wanted to stay, and she was on her 30th day at 11:30. If the landlord was not sure if it was not going to available, why bother trying to rent it out?

because if he doesn't have a renter for it when she leaves, he's going to lose money.

if you didnt have a lease signed why would you give your landlord 30 days notice?

The only reason I can think of is so they aren't loosing out on potential income. They don't get any money for an empty apartment. Have you tried talking to your current landlord? Maybe they will cut you a break because of what happened? Maybe go month to month.

She hadn't even moved out yet and you were supposed to get the keys that day? :confused:

go back to your land lord and say you dont want to move out anymore... just like the girl in the story.

hmm sounds fishy.

The landlord would not give you the keys IF the girl still lived there. That opens him up to a potential lawsuit if something were to happen to her.

why give a 30 day notice UNTIL you knew 100% (signed lease) that you were moving?

just seems weird to me. a landlaord handing out keys to a apartment while someone still lives there? man thats bad.

I was required to kill my lease at the end of May if i chose not to extend it. I have been searching every since then. The notice I gave was telling them officially when i wa sgoing to move out. I have to move out by the end of August anyways.

this happened to me twice at my current apartment. luckily i was able to extend my lease at my old apartment even after i gave them teh moveout notice. i bet i pissed off the the couple that was taking my apartment.

don't know, but her clothes was still in the apt when i looked at it and all her clothes was tiny;)

Hmmm. Whenever I gave a moveout notice, I thought I was *required* to move out when I specified. I.e. I had to pay a penalty (a clean up fee to empty the apt) if I didn't move my stuff out. The whole point of the notice is to give the landlord time to find a new tenant.
