Student suspended after reporting sexual assault. DeVos’ legacy?

Happened in Charlotte—hasn’t hit the national media yet, oh but it will:

Basically, a girl was being harassed by another male student repeatedly. One day, she walks into a bathroom, he follows her in, pushes her into a stall and sexually assaults her. She reports him, the school reports the incident to police, the police investigate and make an arrest, and the male student ADMITS to the assault.

Then, “despite the charges by police, school administrators at Hawthorne Academy High School accused the female student of filing a false report and suspended her.”

What now? Worse—she was forced to take a class called “Sexual Harassment is Preventable”.

Now this is one incident, but another student at the school has also come forward about being made to sign an NDA after reporting an earlier assault. Apparently, this isn’t the only school in the school system having issues like this. The school system has since suspended some of the school leadership in charge to save face.


Is this Betsy DeVos’ legacy? Because I can tell you that when she tightened the requirements for taking action on sexual assault for Title IX, this is EXACTLY what experts said would happen. Heck, just Google the exchange between Sen. Cassidy and Catherine Lhamon at her confirmation hearing a few weeks ago. Schools looking to CYA are resorting to victim blaming as proof of “taking action”.

Biden has already ordered a review of DeVos-era DOE rules and guidance ahead of a possible rollback, but it’s been slow-going, partly because of bureaucracy and the speed (lack thereof) with which his nominees are being confirmed. It’s unlikely new rules will be ready before May 2022.

It's almost as if people that have had everything in life handed to them are poor choices for important policy making positions.

For all of their "personal responsibility" claims, Republicans don't belive it applies to them. Much better to blame the victim.

If I was that girl's Dad, I'm certain what I would do in response would not be legal. The girl's statements are serious evidence. What evidence do they have that contradicts her account?

It’sa good thing Republicans are all about the parents now, right! I’m sure they’ve been paying close attention to…obscure theories not taught in schools…

How so? One incident happened this school year in August. The other was in 2019. I’m not sure about the Myers Park incidents but they were reported fairly recently as well.

Now what I don’t know is whether CMS (the school system) made any changes to their sexual assault/Title IX policies post-DeVos rule or if they’ve been using the same playbook forever. That’s for the board to reveal in the likely lawsuit that’s pending.

I've read it goes back to at least 2015


Our 2015 investigation described how a female student had reported being forced into the woods behind the school by her boyfriend and made to perform sex acts. Both in our prior story and in her lawsuit, the student said that her friends managed to flag the school resource officer—a CMPD officer assigned to the school—who found the pair but decided no crime had been committed because, in his estimation, both students had agreed to skip class and go into the woods voluntarily.
I live about 20 minute north of Charlotte, this have been a big story locally

good god. so who was president and Secretary of Education when this "happened"? this forum is about as swampy as one can get.

I feel that makes it worse... Devos was already coming up with poor decisions running schools so Trump makes her secretary of education... Failing upwards.

The reality is that there are bad people in positions of power everywhere. We know that the vast majority of assaults go unreported. The issue here, is that the student was punished for her report. DeVoss greenlit the "punish the tattlers" approach to managing sexual assault.

About the NDA. NDAs need to be massively restricted to basically protecting trade secrets. It should be a felony to use them to cover up crimes.

A public school should never be asking a student to sign an NDA, WTF...

Generally speaking an NDA doesn't protect you from reporting a crime (not the same as going public about a potential crime), but this is only generally speaking and making no note of what practically happens.
