Although Not Driving, McNair Charged In DUI Case
(WJZ/AP) NASHVILLE, Tenn. Baltimore Ravens quarterback Steve McNair has been arrested in Nashville, Tenn., and charged with
owning a vehicle being driven by a drunken driver.

Police say McNair was a passenger in the silver pickup truck when police pulled the driver over for speeding early this morning.

The driver is reported to be McNair's brother-in-law.

Police didn't perform a blood-alcohol test on McNair. Under the state DUI/Owner statute, the condition of the driver is the issue. The charge is a misdemeanor.

Reporter Robert Goulston from the CBS station in Nashville explains the law.

"In our state of Tennessee, we have a law called driving under the influence of an intoxicant owner. So, if you own a truck that somebody stopped and they're charged with drinking and driving, you too can be charged with driving under the influence," said Goulston.

Maryland State Police say there is no similar law here.

McNair was booked and released.

"He paid a $100, and he left with his entourage. We talked to one person in that entourage and they said Steve didn't do anything wrong. He was in the car, but he was not driving and he was not drunk," said Goulston.

"We are aware of the situation, but we're getting most of our information from the media," Ravens spokesman Chad Steele said Thursday. "We've not spoken with Steve, so we're not sure ... if we will have a statement at this time."

McNair was arrested in downtown Nashville in May 2003 and charged with DUI and illegal gun possession. After a year of legal wrangling, a judge dismissed those charges, ruling that police didn't have sufficient reason to pull over McNair in the first place.

Article is very misleading he didn't get a DUI he got a owning a vehicle being driven by a drunken driver.

Leave it to the media to spin it a way that it really isn't.

So the driver was speeding. McNair was the passenger, and supposedly drinking...but the driver was sober? I'm a little confused as to what the law is covering here...

yeah thats just insane. hopefully he fights it. a law like that should be struck down.
 
What will the manufacturer of the truck get charged with?.. the dealership? ... the salesman?... This all could have been prevented if only the car hadn't been made, or sold. 😛
 
Guy I know had a bad habit of getting other people to drive his car when he was drunk. He had already had 2 DUIs. He would buy drinks for the driver as an incentive. Finally one of the drivers drove his BMW into a bridge abutment and nearly killed him. That law is for guys like him.

It was McNair's car but he was sitting in the passenger seat. The driver of the car was intoxicated and speeding which warranted the stop. McNair was never tested for intoxication as he was a passenger but TN law stipulates that some responsibility be placed on the owner of the car..

I see the point. If you're out with a group of friends, you shouldn't let someone drive knowing that they are intoxicated. I think the issue may be with what the penalty is. As long as it isn't absurd, I don't really have a problem with the law.

edit: I assume that "depending on the facts of the case" means that there might be a distinction between "I let my brother borrow the car, but I didn't know he was going to get wasted" and "I was at the bar drinking, knew that my brother was wasted, and let him take my car anyway."
