Statutory Rape in California

What kind of evidence is required for a prosecutor to even look at a case like this?

I had a gay friend living with me for 11 months, and I'm gay. He moved out because he's a psycho, and they want laptops I bought etc or they say they'll file "statutory rape".

Yes, it is practically black mail. Let him keep living here free, or give them sh*t forever, until the Statute of Limitations to file runs out.

Whether we had sex or not doesn't really matter, they'll file just the same.

What counts as "evidence" though?

You are an idiot, yes it matters, if you had sex with a 15 year old you are guilty of statutory rape and will be convicted. Meaning if you had sex with him he has proof, if not then you should be golden. Don't have sex with minors regardless of your orientation.

If you haven't already, I'd suggest you start keeping records of the threats that they're making against you. Blackmail is definitely illegal, and proof of it would greatly damage any case they could bring against you.

I really don't know what type of evidence or proof they'd need, but I'd imagine medical records and such would be the most common type. If this guy's waited months/years to report, and you have that proof of blackmail attempts, then I'd think many courts would simply throw the case out.

I think I remember reading somewhere that california's statutory rape law is different from many other states in that if the age difference between the two parties is less than two years (and the sex was consensual), then the penalty is either reduced or dropped completely. I could be wrong about that, though.

Well there is no "proof" because it didn't happen. I just wanna make sure a convincing sob story doesn't count as "proof".


He only threatens this because I made him leave and go live with his welfare supported parents because he wouldn't go to school.

There's no way you can get in trouble since there is no proof at all. You're safe, tell him he's a piece of crap when you next see him.

I'm not attracted to him, so NAMBLA isn't really applicable.

His parents here are supported by the welfare system, his parent in Missouri just had no electricity and other stuff. I thought I'd be doing him a favor, but he never took advantage of anything, never went to school, never tried to improve his life or anything.
