statue of limitations on insurance claim?

Back in april a guy bumped my girlfriend's car (just minor paint damage) and left a note. I have been busy and things have been happening etc. Is it too late now for me to make a claim to his insurance company? Any statue of limitations?

Wondering if that'd be lumped in the same catagory as personal injury. 2 years in cali. Not sure about there.

In california it's 3 years for a property damage action. I'm going through getting money back for an accident I had 2 months ago.

Well, you shouldn't be too concenred about the statute of limitations unless the insurance company says they're not going to pay. If they say that, then you'll have to sue the guy who bumped into the car (if it's small enough, small claims court is probably the way to go--you won't have to pay for a lawyer that way). Anyway, the statute of limitations depends on which state you're in, and what you're suing for -- in your case property damage. (I can't think of any limitations that are less than a year -- many of them are for 2, 3 or 4.) But then again, I'm just starting out working for a lawyer -- so, you know, usual disclaimer.... don't trust me, I don't know what I'm talking about, etc. Findlaw.com is probably a good place to check what the limitations are in your state. (I tried to check in Florida for you, but the Internet's being a littele too slow.) Hope it helps.

I haven't called the ins company yet. For some reason I thought I might just let him pay me after I get a quote but didn't have time to do that. Screw it, I'll just get the insurance to pay (hopefully overpay). If there's any problems, he works where I do, I could just beat the schiat out of him...
