on august 8th i fell and hurt my ankle pretty bad. it was both sprained and cut (i had stitches). so i went to the emergency room that day and had it fixed up. they told me to go have the stitches taken out in a week but that no follow up visits were necessary regarding the sprain unless conditions worsened.
i had the stitches taken out at a regular doctor but still couldn't work because of the sprain (i was on crutches and i work in a restaurant). about a week after that my boss told me to look into disability so that i could pay rent. well another week and a half went by before i brought the form to the doctor that took the stitches out and when he filled it out he said i should have been at work a week and a half ago (there is a space on the form for him to tell the state that info) because he was only judging by the cut.
so basically i missed almost 5 weeks of work and because the emergency room told me not to bother having the sprain looked at again after they diagnosed it the state believes i was only out of work for 2. that is an extra $498 that i pretty much need right now so that i can pay rent and eat.
i wrote them a letter that explained the situation and mailed it with the forms. they sent a check for just the one week (the first seven days don't count no matter what).
my question is this: is there any way i can appeal their decision and prove that i was really out for more than the 2 weeks they think or is it too late now?
