Start menu enoyance

reformat I guess? kind of a silly reason to, but after lot of investigating I cant seem to figure out what causes this, and it's a real anoyance.
 
Anyone? this is driving me up the wall, and it's only getting worse, almost every 2nd program I open causes the taskbar to go under everything, and yes, it's checked to always be on top. I'm thinking of writing a program that keeps clicking in the lower right corner every 500ms but there's got to be a better way then a crappy work around and that would make my mouse all choppy.
 
This is going to sound stupid, but it works sometimes.

Unlock the taskbar, and try moving it to the top or side for a few minutes. If it doesn't happen again while opening a program, try moving it back down to the bottom again.
 
Tried it, it seemed to stop doing it when it was on top, but I put it back on bottom and it's doing it again. I've been debating on doing a format, but I rather wait till christmas break for that, have no time these days.
