SSD and S3 problem

the HTPC in my sig below has been running happily since may 2009, It was running solely on a 1TB Caviar black, but last week i added a sandforce 1200 based 60gb SSD, and ever since that, S3 is a bit whacked.

It goes to sleep fine, but upon wakeup it either freezes and BSOD at the logon/password screen or right after entering the password and trying to click on anything.

Hibernate works fine and rebooting is fine as well. the bios only has S1 or S3, no auto or both options. I changed it to S1 and tried that and using that everything works fine.

But as i understand S1 still has the cpu powered on which i would prefer not to have if possible.

I had emailed a great tech support guy at Mushkin (the SSD brand) who said that he knew gigabyte had S3 issues with Sandforce drives, but I couldn't find anything else online about it.

So I guess what I am wondering, is if anyone else has a similar issue/fix or if anyone uses S1 instead of S3.....not sure how i want to proceed at this point.

the drive has newest firmware, mobo has newest bios etc etc.
 
requires a fixed firmware or rma the drive and get an x25-v/m/indilinx.

it's the drive. really. all manufacturers. x25-v = solid wake up every night (you know the pc does its virus update/etc every night)
