Speeding ticket

Ok I got a speeding ticket going to a concert on satruday. I was giong 74-75 on a 65 mile an hour road..not outragoues..flow of traffic...the cop said I was going 81.

That not only puts me up to 4 points...80 is 3, 81 is 4. The guy was a jerk too.

Anyway, I want to fight the thing cause there was no way I was going that fast.

He was using Radar.

Here is what I think i should do..any help is appretiated.

1. Pleade not guitly
2. Hope he doesnt show up
3. Tell them that I was going 75 and hope that they reduce it becuase I have a pretty good record.
4. Here is the interesting one. I was told today from a friend that if they cop is not viewable from either direction for atleast 1/2 a mile then it wont count. Apparently they have to be viewbale from a distance.

I live in PA..any help on that 4th thing would help...I deff didnt see him until the split second, and it was on a curve so I doubt it was viewable from both sides.

I wouldn't tell them you were going 75, you're still admitting guilt.

From my experience, most ADA's will reduce to 9 over if you're not going ridiculously fast.

You could also get a lawyer; the few hundred bucks you spend on one will probably ensure you don't get any points, but that really depends on the laws where you live.

i dont know, I cant find the laws that cops have to follow when setting speed traps online.

kinda like I know the cop HAS to have his lights on in PA to clock you..he cant hid with his lights off...cant find that law either..but i know it for fact.

So if i cop pulled you over for speeding, gave you a ticket, and then you told them he was sitting in the dark and they believed you..your ticket would be voided.
 
You take it to court and fight it, but you probably won't win. Doing 75 in a 65 zone is still going over the speed limit by 10mph. Also, if you've ever been stopped before, and you have a record, your credibility will be shot and the court will probably side with the cop. Oh, another thing... I agree with LoKe on that rule about "1/2 mile visibility" and call shens.
 
I still have a speeding ticket to take care of, I was going 65 in a 40. I dont think I was going that fast either. Turns out the cop was not in his car, rather hiding in a bush. I didnt see him at all until he ran out on to the road and waved me down. I wonder if i have a case? I already used a lawyer a few months back for another speeding ticket. Should I go back to the same lawyer?

i don't know about #4 because i live in PA also and they love to hide. in fact, the other day i was heading to lunch and there was this cop parked behind this bar. on my way back to work, he had a truck pulled over just a little furtherup the road. coming back to work, there is no way you could see him.
 
I have never been to Court in PA, but in Jersey, all you can do is go to court and talk with the Prosecutor before your name is called. If you have a good record, they may reduce it to just a fine, or a lower offence. Don't rely on the cop not showing up. The cop will most likely be there. Cops have a specific court datae they must attend every month. they scedule all of the tickets they write to that one date. I have talked my way out of tickets almost everytime I went to see the procecutor. So it is worth your time. All they want is the money.
 
What kind of car is this and have you changed the wheels/tires significantly? I suppose it's possible that if you changed to a larger tire, your speedometer could be off

how did it go with the lawyer. My parents have a lot of lawyer friends if you think they can get me out of it I might try that. The fine is already 150 bucks.> I would pay 200 to not get any points
 
To beat a speeding ticket, you have to lie. You must say that your cruise control was on 65 and you know that you did not speed.

If you say you were going 75, you have admitted guilt. Because you were breaking the law, why would they believe you were going 75 and not 81? They will always win a word for word argument. They have had thousands of people in your exact shoes.

Be warned though. You will have to go in twice. The first day is a plea date (guilty or not guilty). The second date is your actual trial.

The prosecuting attorney is usually very short and rude with you. They have heard every story in the book and could care less about yours.

They will ask "How fast were you going?" You say "about 70", they say, "Oh, so you weren't paying attention? I think the police officer's radar is a better gauge than what you "think" you were doing. Anyway, 70 is speeding and that is an admission of guilt. Please pay your fine now."

They will also threaten you with things like "A speeding ticket is a 3rd degree misdemeanor. You could spend a maximum of 30 days in jail and a $5000 fine." Use common sense on that one. The judge would never do that to you unless you had 50 in a month.

Speeding tickets are another source of tax collection. You are a cash crop. Whether you were speeding or not, they will get their money from you. It's not about morals or safety, it's about collecting money for the system.

Again, I will restate the most important fact. YOU MUST LIE TO FIGHT THE SYSTEM.

Aye, those PA State Police cars are evil. Black with dark gold lettering, and lights on the inside. Horrible at night.

 
From my experience, if you havent been cited often, the lawyer can get you off real easy, you may have to pay court fines though, that is the Judge's way of saying, "ya i'll let him off, but lemme throw the last punch" and the court fees can vary, because the judge sets them. I've used a lawyer 3 times for a ticket, my first time(1st ticket, ran a stop sign) paid the lawyer $60, and everything was taken care of. The 2nd time I paid the lawyer the same ammount, but had court fees which were like $45 bucks. The third ticket I still have yet to get any updates or w/e. Now I have another one to take care of. Sorry if my post is screwy,im typing this quickly cause im about to run out and get some food, and no im not speeding.

I don't think you will continue to win, you might try slowing down and going near the speed limit 😉

Not true. I have "beaten" many speeding tickets and other offense, just by asking if I can have a break or "can we lower this to a non-points offense". Never have I lied and said I did something else. That would imply the cop was wrong or lieing and he could take offense to it. I did have to hire a lawyer once because the cop was being stuborn. I have no idea what the lawyer said to get me out of the points. I did have to pay a fine though. The prosecutor is just as normal as you are in these situations, and many times will sympothize with you.

Also, Admitting to a lower offense might be the best route. 2 points on your license is better than 3 or 4 points. Take what you can get.

I believe you can make your plea by mail, and then the second phase would be the trial.
You do not have to lie, to beat the system; you just need to know the law and ways to work around it.

I've never tried it, nor have I ever had a ticket, but on the trial date, you will have the opportunity to cross-examine the officer.
From what I understand, the officer should be officially trained in the use of the speed detection device; the radar should be calibrated, and it must maintain its calibration.

What if you just went ahead and pleaded guilty, paid the fine, but then found out the radar detector was out of calibration by 12 months? You'd feel cheated..

This is traffic court there is no cross examination, there is no witness stand. You wait for your name to be called you stand up in front of the judge, he states the offense, and you say whether you are guilty or not guilty. if you say not guilty, then you schedule a trial date( this rarey happens). Usually you work out the "arrangements" with the prosecutor before hand.
