Speeding ticket.. what would you do?

I'm in TX and I got a ticket that I think I should take to court.

3 lane highway, posted speed limit 60. I'm driving in the center lane with cruise control set to 65 and this car on the right lane is going -much- faster than I am, I'd say about 80. The other guy pulls over after seeing the state troopers lights and I keep going since to me, it was the other car that deserves to be pulled over.


Trooper pulls us -both- over, accuses us of racing and then writes tickets for 80 in 60.

I really think that it was the -other- car that the cop's radar tagged and it is very unfair, so I want to fight this ticket. Is there anything else I should consider before stepping into court?
 
chances are you're not gonna win. gotta love the justice system.

unless you have video evidence you were doing 65. even proving that you don't know this guy, the system could argue road rage or something...

try going to court with it and hope that the officer doesn't show up.
 
when the other guy was already pulled over, the trooper then gets back on the freeway and gets -me- to pull over as well.

it sucks but i always hear about state troopers pulling over multiple cars..

I'll have to be quite careful the next time I pass through Katy, I guess. 😛

Good luck with the ticket though, that sucks. I've only gotten one before, but I deserved it (83 in a 65, and I had actually been going faster than that but slammed on the brakes...). I don't do that anymore. 😛

synthdude- hehe, the profile needs an update. I went to high school in Katy and I now go to UTD. General advice: 35 is SWARMING with cops around Lewisville/Denton, hence the cruise control!

Ah, thanks for the tip. I actually have a friend who goes to UNT, and I'll probably be going up there to visit him again soon (was just up there about a month ago too). For reference, I'm in College Station for school right now, originally from San Antonio.

But like I said, I don't really speed anymore....I used to be pretty bad about that, but I suppose I came to my senses or something. 😛

Oh, and my cruise control isn't working right now, I need to get that fixed. 🙁 I used to use that ALL the time.
 
I got the very same problem like you a few year ago (late at night, I drove outside lane, not speeding). You just have to go to court and explain to the judge. If he is in good mood, he will just reduce the ticket and you probably have to go to traffice school but no heavy fine and no point (insurance).
 
The thing about fighting tickets is that it's your word against the officer's.

You have to come up with proof that the cop is not credible in what he says.

Your best bet is to tell your story to the judge and hope the officer admits there may have been a mistake. You might be able to bring things up like "The officer cannot prove that I was going at this speed"... but you can't prove you weren't.


 
Take it to court. Just tell your story.

Where I live, judges still rule honestly. If they don't have enough evidence, it'll get thrown out. In fact, city officials in memphis often complain about how many tickets get thrown out. The judges just reply that if there's not enough evidence, they'll throw it out everytime.
 
I thought to be considered "racing" you have to know the other guy..

At least that's what happened to my mom. She and some other guy (same situation as yours) were pulled over. The cop asked if she knew that other guy, she said no, and she was let go. 🙂

The VERY first thing you need to do is put it in writing, sign and date it like a log and notarize it.

Actually, there are so many ways to circumvent things like this.

Make up some BS that you keep a log everyday of what crusing speed you keep your car at because of previous tickets. Then whip out your log (that you made up) that shows ur log for everyday since the past 2 years.

 
Usually, on ATOT, anyone posting about speeding tickets deserve it and just try to weasel their way out of paying/taking responsibility.

However, your case sounds like you really shouldn't pay the ticket. It is definitely unfair imo that the cop assumed you two were racing.

Of course you could be blantantly lying to us all, but chances are you probably aren't 😉 Anyways, I say fight it. You don't deserve that ticket.

btw, I'm from TX also, went to UT. In Sugar Land now working.

I do not see an officer admitting he was wrong especially infront if a judge.

either way, he wrote down racing even though I told him that I don't know the other guy, so we'll see.
