If this kind of referendum goes down to defeat, big time, in an ultra conservative, reddest of red states, it proves my point that this country, regardless of my personal feelings, is pro-abortion rights.

I do not see it the way you do.

Most people do not support a total outright ban on abortion. But most people also support some restrictions. Parental notification, no late term abortion etc.

I would not call a vote to ban all abortion some kind of bell weather victory for the pro-choice movement.

The thing is they gambled big and lost. If it has stuck it would have had a domino effect across the states. If they had used a "with restrictions" they would not have gotten the ban they wanted nation wide. In the end they had to go big or go home with a total ban. It got shot down by the public in what they saw as there best turf to get it started.

So in essence, the total ban on abortion will be a dead issue for another 5-10 years.

Agreed. I do not agree with abortion, but I would not want to ban it outright. I'm for some restrictions like you noted.

Sure, but isn't it unfair to the unborn fetus? I mean, its not the fetus' fault for the reason it came into existence.

Fetuses don't have right.

Yes it does. If you punch a pregnant woman in teh stomach and the fetus dies, you go to jail.

Well, that's a unconstitutional law then.

Yep.

How so? Murder is not even in the Constitution. It's a state issue.

11-8-2006 Bush asks USSC to overturn Row Vs Wade now

Six federal courts on both coasts and in the Midwest have struck down the law as an impermissible restriction on a woman's constitutional right to an abortion that the Supreme Court established in its landmark Roe v. Wade ruling in 1973.

Bush appointed both Roberts and Alito, and most legal analysts believe that neither man will be especially supportive of abortion rights.

What a useless ballot initiative. Even if SD passed it, the initiative wouldn't do jack unless the SCOTUS strikes down Roe v. Wade.

That was the goal of the initiative, to bring the issue to SCOTUS.
