Sound problems in Win2k with games

I recently built a new computer and put win2k pro on it. It runs fine except that my sound is sometimes screwy in games. It works fine in windows itself, I can play mp3s or streaming audio with not problem. When I load up NS I get weird sound issues during the menu (kind of choppy sounding) and sometimes during the in game music but in the in game effects work just fine. And then while messing around in the free shadowbane trial all of my sounds were messed up and choppy.

I have all the latest drivers for all my hardware so I'm sort of at a loss for what the problem could be. It hasn't really affected me yet but I'd like my system to be 100% working not slightly messed up on some games.

Systems is:
Biostar M7VIZ (VIA KM400 / VT8237)
Athlon 1800+
512 MB crucial PC2700
WD 40GB SE 8MB
Memorex 2462 CDRW
Geforce 256 DDR 32MB
using the onboard sound (Cmdia9739A, 6CH Audio) and on board LAN (VIA VT6103)

Like I said all drivers are up to date so I figure this must be a settings issue. I have set the sound acceleration to the recommend level, it can go one level higher but I have not set it there yet.
