You guys seriously can't be wondering why the DA didn't try to prosecute with a charge of non-consentual sex.

Oh, I do not think that people who want to have sex with dead people should be in prision... they need to be in a mental institution.

This is a completely irrevelent point. If the girl was alive she would be scared for life. Having sex with a corpse hurts nobody except maybe the person having sex and the family of the corpse if they find out.
