Say a customer in a resturaunt suddenly starts choking on a piece of food while the waiter is standing while at the table. What if the waiter doesnt know the Heimlich Maneuver? Can the waiter or resturaunt be held liable if something were to happen to the guy?

It's called the "Good Samaritan" law. Basically, you can't be sued for helping someone and messing up, or for not being able to help someone. However, if you just sit there, you can be sued. If you call 911, you've succeeded in CYA. However, if your a doctor, EMT, or paramedic, that doesn't apply.

ummm, it depends on state. some states have good samaritin

for example: Vermont penal code 2.01:

a person who knows that another is exposed to grave physical law shall to the extent that there exists no peril or danger to him/herself, provide reasonable assistance to the exposed person

edit: thats a paraphrase of the Vermont penal code, but its fairly accurate
