Someones stuff in my garage

An acquaintice was temporarily living with us while he was working on our roof. Was purely informal and no rent was given (even though the party agreed to pay us $800). So after two months and a total of $800 wasn't payed, I kicked him out. Some of his stuff is still over here (a tank, some tools, other various small things). Are we not legally allowed to sell the items or do we have to continue to let them stay in our garage.

Cliffs:
1) bum promises to pay us $800 while living in our house
2) doesn't so we kick him out
3) tools in my garage
4) ...
5) profit ?

was the promise just a verbal agreement or do you actually have a written contract

Took me a good 3 minutes to figure out that word.

an evicted tennent has no rights to store stuff in your garage. Give him/her 30 days to claim the stuff, if he/she does not show up, set it out on the street.

You shouldn't do anything without giving them fair warning and ample time to arrange to pick it up, especially if it is a bit larger... and moreso if it was only a few weeks ago that they left.

Also keep in mind that you cannot hold the stuff for ransom, agreeing only to give it back when he pays his bill. It is his stuff, and he is entitled to it regardless of other arrangement, but he also has no right to store it on your property.

but since he didn't sign a lease, he legally wasn't a tenant....

What state do you live in?

How long after you kicked the guy out has his stuff been there?

Has he contacted you about it or attempted to get his stuff back?

Have you contacted him about it or attempted to give his stuff back in return for
the money owed?

You may have to check your local laws in regard to property abandonment, and
if it has been long enough to claim his stuff as having been abandoned.

I had a former roomate move out and get married a while back. He made sure
he took everything he valued at the time that could fit in thier new home; but that
still left me a garage and trailer full of "junk" that he didn't feel like dealing with.

I tried a couple of times to see if he wanted any of it back, and after the third time
of him saying "No, you can keep it or throw it out" I took that as permission to
do what I wanted with it.

Now if some collectable he once owned shows up on Ebay, he'll have no cause to
complain.

Every state is different, some require legal notices posted or served. Check with the police.



Of course you can do anything you want if you're willing to lie in court.

no, i'm sure he has taken only the important things out or the stuff he can get in his car.

he doesn't have any money to give. constant problems with the law.

contract was purely verbal. but i have a witness so it would be 2 against 1. so the consesus is 30 days notice or sell?
