some legal advice please?

a friend of mine was just fired from work, and his office gave him no reason as to why they fired him. it was him along with a few others.

my question is, from a legal standpoint is there anything he can do? this is for NY. like is there some rule saying that they would give him 3 months notice or is it even legal to fire without notice?

he's never been "scolded" at work, had no performance reviews, nothing. he's worked there 3 months and has been what everyone would call a good worker- he's got his stuff done, not complained, stayed overtime to get the job done.

any advice for him?

I'm only a lawyer in Gotham city, but it is an incarnation of NYC, so who knows how it works out. But, do companies in NY have the right to fire you for any reason (or no reason) at any time? It's that way in VA, so I'd guess if it's that way up there he needs to look for a new job. 😛

I think it can depend from state to state or company. Every place in TX I've ever worked at has a "fire at any time for any reason" policy. I don't see why you're getting your panties in a bunch. He obviously did something wrong or pissed someone off to "deserve" it.

I can only speak about my state (Illinois) which is an "At Will" state. Either the worker or employer can terminate employment at any time without notice for any reason (except those reasons that are illegal).

By not giving a reason, they are protecting themselves from a lawsuit. The only good side is your freind gets up to 6 months to find another job with that company still paying him.

Depends on the state. Utah they dont have to give you ANY reason whatsoever. Some states are different though - check the local laws.
