Some jackass backed up into my hoopty....

I bought a 02 Chevy Prizm last year as a hoopty when gas was on it's way up. 28mpg city didn't sound too bad. Paid $4200 for it with 65k miles... not great, but not bad IMO.

Anyway, yesterday I was on my way home (in a 20mph zone) and some jackass starts backing out of his driveway about 20ft in front of me. I lay on the horn and try to stop.... too late (snow and ice on the street made it impossible to stop). The front corner of my car goes under his rear fender of his truck and jacks up my hood, fender, and completely destorys the rear supports for my passenger side headlight.

I called the cops because he didn't have insurance on him (maybe 18 years), but he said "I work at a local used car lot, this is one their cars, it's covered!" Sure it is, but you are required to have personal insurance even if you're driving a car from work. I put the claim in and we'll see what they say...

I don't think they're gonna be able to hammer out the dents, so it's gonna cost some money. It's rattling pretty good too on idle, though I think that's the headlight assembly.

Jugs < Hasn't been a accident in like 10 years

EDIT: The dumbasses insurance called and said everything they heard from the witnesses went along with what I had said. I asked them "So the other driver accepted all liability?" To which they said "No, but we are..."

A $4000 car qualifies as a "hoopty"? I thought a hoopty was an old POS you picked up for really cheap and don't care about.

I'd certainly care about anything I paid $4000 for! :p

My $350 Grand Marquis that I drove for two years was definitely a hoopty... I don't even consider my $800 Volvo a hoopty :p

I call it a hoopty because it is a basic, almost no feature car. No power locks (although I put an aftermarket in), no power windows, no cruise, no tilt wheel, no antilock brakes, only a 3 speed transaxel, etc.

If it was brand new, it would be a hoopty in my eyes. :)

I was under the impression that you had to be on the policy of the car's owner. You shouldn't need insurance just to have a license to drive, but mandatory liability insurance is required for the car/driver.

It depends on the state. In New Hampshire, insurance isn't even required :Q

Get this, I just talked to the dealers insurance adjuster and after I gave my statement to her she said "Ok, well it's looks like our client is.... kind of disputing liability. You should get our decision tomorrow."


WTF? He backed out into traffic and hit me and it's not his fault? WTF? My coworkers, say they probably just saying that as a formality and will probably say he was liable anyway, but this sucks. This normal is your guys experience?

They will likely try to pin some % of the fault against you. They will use a bull shit line like, you should have been able to stop in time so you are 25% at fault. Happens all the time.

"Too fast for conditions" is how they will try to get you to take some responsibility.

That's pretty much what my insurance said, they said the worst that can happen is they pin a small percentage of the accident on me. Considering my car was the only vehicle to have damage, $1600 according to a body shop, my check will just be smaller....

I can get a new headlight assembly on ebay for $65... so I'm ok with only 75% of $1600. :)

Don't let them pin ANY of the blame on you.

The check is coming to the house and I was able to pretty much remove all of the dents with my hands and some basic tools. :)
