Some advice over who is at fault UPDATE

ok.. about a month ago I setup ING to automatically withdraw $300 a month. stupidly.. I forgot about doing that and dumped all but like $200 into my ING account about a week and a half ago.

So on monday night, the $300 from ING overdrew my account. $30 charge
oh but wait.. on saturday I bought:
.89 of gum from a gas station ($30 charge)
$4 in gas ($30 charge)
$3 led pen ($30) charge
sunday went about the same.

I had $150 in overdraft fees. I went to wachovia yesterday and talked to the lady at the front desk... she took off $60 in fees, checked my account for pending transactions (I hadn't used my card since sunday) and signed me up for overdraft protection. I asked her if I needed to deposit cash to cover my acct or if I can wait until I get paid.. she said as long as I didn't use my card since sun I can wait until thursday before 2pm.

so today.. two misc charges popped up for a total of $60 more in fees.
::NOTE:: my problem ISN'T with the initial fee's.. that's 100% my fault... but what about the 'new' $60 in fees? I didn't use my card at ALL when she said I couldn't
What would you do?
1) It was 'assumed' that overdraft protection was instant. She never said otherwise anyway.
2) I was told that no transactions would clear last night


on the otherhand, I really *should* have deposited some money... but she said I didn't have to


UPDATE:

I send an online message voicing my opinion on the 'new' $60 in fee's. I also pointed out that the total of overdraft fee's was $210 over about $17 or so worth of purchases, and that I felt that as a customer this was horrible treatment.


They refunded ALL of the overdraft fees and agreed with me that it was sucha trivial amount of an overdraft..... Wachovia rocks....

If you knew there wasn't any money in your account, you shouldn't have been using it, regardless of what that lady said.

OD protection is NOT instant. OD protection, to a bank, is the equivalent of a credit card/any line of credit you get from them. The application process is similar to that of a credit card.
Either way, the person you talked to at the bank is an idiot and you should go talk to her and, even though you're specifically not entitled to your $60 back again, you can at least go figure out why you got charged your OD fees - who knows, maybe you'll get them back a second time.

You thought the bank was looking out for you, and that's never the case. Sorry you got nailed but it's not the bank's responsibility to guarantee no transactions will go through.

I think you have a point that you were led to believe the overdraft protection would be in effect at once. I'd contact the bank and pursue that angle. Try to do it with the person who helped you before.

Keep better records. Try using Quicken or Money. You should always know EXACTLY how much money you have in your accounts and what charges you have pending. You just learned that the hard way.

Remember...the Bank is never at fault.

I got hit with OD fee once only because they process withdrawls before they process deposits. Which they do on purpose, BTW. Earns them more in fees. (at least at my bank)

/me hugs his CREDIT CARD.

My checking account is only used for 4 things:
  • Checks which is pretty rare like rent and car payment. Everything else is done online and paid with a credit card so I can itemize my statement at the end of the month, 25 day grace period and to EARN REWARDS from paying our bills. Even my car insurance can be paid online with a cc!
  • Supermarket/grocery stores, I love POS terminals. Get cash back.
  • ATM which is pretty rare.
  • Paypal transactions.

If you ain't got the dough, don't act like you got the cash and do the auto deposit like the rich folks.
 

Something like this happened to me, long story short:
Its your fault, they have the upper hand, best case scenario is that you talk to a branch manager and get more fees refunded. Dont count on it but its worth a try.

On top of their crazy awesome random question logon, maybe ING need's a 'drunk detector'.... something where you have to copy typed text and if it's wrong they don't give you access
