Every CPU is different. There is a chance that you have one that takes more voltage. But your voltage @ stock speeds is within the Intel spec, so your chip is not defective. You may just have a poor OCing CPU.

Does it run as advertized?
If no, then:
Have you attempted to run it higher than stock settings?
Only if the answer to both of these is no can you RMA it. Otherwise, it's warranty fraud.
