Sold my 6800 Ultra on ebay, now the buyer is unhappy

I just got a message from the buyer stating that he is having problems with overheating and that his games and benchmarks won't run. He wants a full refund of the purchase price. I stated in the auction that I will refund the money if the buyer complains within three days (it has been four) and if there was no modification to the card (he installed an AS5, which was included with the item but was not installed when I shipped it, nor was it covered under my warranty). While I can confirm that this card does run warmer than an average 6800 Ultra, I did not have any problems with artifacts or crashes with the stock cooler. Is this guy entitled to a refund?

BTW, I purchased this card new in February on the FS/FT forum.
 
let's look at the facts

1. he takes off heatsink (devalidating warranty)
2. he puts on AS5 (most likely doesn't clean off old stuff)
3. he puts heatsink back on (probably doesn't seat it right)

Now where in those steps does it say you caused the card to get hot? Oh yeah, and since he ruined the warranty, he's stuck with it now.
 
Clearly he installed the AS5 wrong and that's causing the problems. That's not a reason to take back the card.
 
ask him to tell you exactly what he did to the card and try to correct the problem
in addition to that....say the card's warranty is voided because he took off the heatsink

on the other hand...did you ever take off the heatsink yourself?
 
yeah he probably made a sandwich with the CPU and used Arctic Silver as the mayo 😉 .

Ask him if he applied a *thin* layer of the stuff, what kinds of temps he's getting, etc. Also ask if he did any testing before he took off the heatsink (anyone with half a brain should test out the stuff they buy before they mess with it). He's probably just pissed it doesn't overclock well and wants to take it out on you, or something.

Also, although you did say he had 3 days to test it out, you also said 'without modification' (which he did).

Still, if the guy is appearing to be a royal pain in the ass, you might want to just bite the bullet and take it back. Some guys are so annoying and persistent that it's just not worth your while to argue with them, and just move on...
 
What brand is the 6800 ultra anyways? Looks like a reference card? Whos it under warranty with then even if he didnt void it? I mean there is a reason all manufactures say the warranty is voided if tamperd with.
 
yeah, no way he is getting his money back. thats just like buying a brand new 6800U and slapping an NV5 on it, then complaining to eVGA when it overheats.
 
ask him for exactly what he did on the card. Then if you see a spot where he screwed up on, you have a good excuse of saying no for the refund. Just find proof and give a good excuse. Try to outsmart him.
 
Maybe not enough airflow? Its not your problem anymore though. I would suggest that you ignore him.
 
Lemme clarify a few things here:
I did install the AS5 at one point, but removed it because of overheating problems- check out some of my earlier posts about it. The stock cooler works just fine though. This is a reference card so there is no manufacturer warranty, just my personal warranty, which consisted of a 3 day (after receiving the item) no DOA guarantee. According to the Fedex tracker, he got it on Thursday and complained today, which is four days. If I give him a refund and there is permanent damage to the card, then I'm screwed out of almost $300 since I have no one to RMA it to.

I think it's an airflow issue too, I told him to try putting in a case fan in the adjacent PCI slot.
 
HS is not put on tight enough or he has some sort of short due to gobs of the AS5 (which i think conducts)
 
lol why did you sell him the AS5 in the first place when you knew it might cause problems? anyway just try to help him out, tell him to put the stock cooler back on it might help(maybe) and tell him that he extended the 3 day period and voided your warranty by changing the cooler hence you wont accept a refund.

i think they're interchanging as5 and ac5, as in artic cooling 5.

there were some issues with some ac5's not sitting properly, as if warped, so they wouldn't make good contact.

did he try the stock cooler with the same results?

i think you goofed . . . it is not at all "clear" 😛

if he got it Thursday, today is the 4th day [but some people don't count Sunday as a business day] - you may be able to work with him in getting him to reinstall the old cooler [correctly] by reminding him that is is out of the 3-day warranty period 😉

use whatever leverage you can . . . good luck . . . and please update us
 
I'd try to help him first. Ask him if his case cooling and power supply are adequate, if he installed the drivers (and uninstalled his old card) correctly, why he installed the AC5, and if he physically installed it correctly. I'm inclined to say he's really out of luck, as your terms were painfully clear, but I'd try to help before talking about refunds.

I hope this isn't buyer's remorse because he saw a better deal elsewhere.

basically it's not explicitly under the warranty you implied/agreed to... but i would just try to be cordial and help him get it running right. if the card was received by him with no problems, then putting the stock heatsink/fan back on correctly should solve the problem and make him happy...

another suggestion i might recommend is you might offer to purchase and ship him a new arctic silencer (if you think he's capable of installing it correctly) as mine certainly works great.. and even state it in a way like, "we both know the card is fine; if i sent you a new AS5 would that make you happy?". make sure he says "yes" (no sense doing it if it's not gonna make him happy, heh... and while technically you're not obligated, and it costs you a few bucks you don't have to eat it all and you end up with a happy customer and good ebay feedback.
