on monday got a USPS overnight package in and im like WTF is this? i open it and there are two copies of Nortons Internet Security CD's in the package along with a 80 buck invoice.

Today my wife calls and asks me about a 80 buck charge on our credit card for something at softwareoutlet.com :|

I just called the F*cers and they are wanting to charge me a 20% restocking fee. :| :| I tried to tell them that i didnt fricken order this software and will return and they take off that charge on my CC. but i guess that concept is beyond his abilty or against company policy.

Im going to call back in a hour or so after i calm down and im going to explain it to them one more time. if the still insist on charging me a 20% restocking fee for something I didnt order i will tell them that by law * i can keep it and ill call my cc company and dispute the charges.


* remember this from my high school law class back in the day. is this still the case?

Do Consumers have to pay for unsolicited goods or services?
No. Under section 29 of the Fair Trading Act (the Act), it is an offence for someone to ask for payment from a consumer for goods or services that he/she has not ordered. The biller is not allowed to do anything to get payment from the consumer. He/she cannot threaten the consumer with legal action, send debt collectors or place the consumers name on any list of defaulters.

What should Consumers do with unsolicited goods?
If consumers have not ordered goods, they do not have to pay for them. They can do one of two things:

The consumer can notify the sender of the goods that they do not want them. This notification must be in writing, and the consumer must give the sender the following information:
his/her name and address;
the address from which the sender can collect the goods;
a statement saying that the goods are unsolicited.
The sender then has one month to claim the goods. If he/she does not claim them within a month, the consumer may keep the goods at no charge.
The consumer can do nothing. The sender of the goods then has three months to claim them. If he/she does not claim then, the consumer may keep the goods at no charge.
The Act stipulates some circumstances under which the consumer is not allowed to keep the goods. If the consumer could reasonably be expected to know that the goods were not for them, for example if they were not addressed to him/her, he/she is not permitted to keep them. Nor is he/she allowed to prevent the owner or sender of the goods from taking back the goods.

How did they get your credit card number and name and address and cell number? I'd be looking into this in a hurry. Thank goodness for the credit card dispute process. Hope it all gets settled in your favor and soon.

I wouldn't waste your time with the merchant. Call your CC company and say the word fraud, and they will handle the details. You made your earnest attempt at resolving the issue with the merhant, and they wouldn't do the right thing. Don't stress about it.

have you ordered from them in the past? sounds like a billing error.


also, if you have bought from them before, your existing client status may prevent you from keeping the goods for free.

Nope never heard of them until i got the package. i have never ordered from this company.
