Software Patents: Stifle or promote innovation?

With the Java/Kodak thing recently, you have to wonder why anyone would want to make software out of fear of being sued.

stifles competition to protect the uniqueness and marketablity of a product - good if you invented it.

on the other hand, if this protection was not in place, people would not be interested in innovating because another company could just rip their code and all of a sudden everything they worked so hard for is not that special anymore
 
I've yet to see a case where software patents helped anything. Of course, now I wait for a Kodak troll to come out of the woodwork and lecture me on this, but whatever... :roll:
