Although we will mail you a policy booklet that explains your rights and responsibilities in detail, please read the following for an overview of how the Unemployment Insurance Program works.
In order to receive Unemployment Insurance Benefits, you must be unemployed through no fault of your own. You must be able and available to work. You must look for work in your usual manner and you may be required to register for work. And, you must have qualifying wages.
The amount you qualify to receive is based on the wages you earned during four quarters that are your base period. We will mail you a monetary determination that notifies you of your weekly benefit amount and the maximum number of weeks you may receive if you are otherwise eligible. You should review this notice carefully. If the wages shown do not reflect all of your covered wages, call your local office and staff will instruct you on requesting a wage reconsideration.
Even if the wage requirements are met, benefits could be denied if you quit your job without good cause or if you were discharged for misconduct in connection with work. Other issues could affect your eligibility. You must report any of the following: refusal of work, receiving a pension other than Social Security, starting a business or entering training. Your policy booklet will explain other potential availability issues.
Whenever any potentially disqualifying issue arises, you will be asked to give a statement. If applicable, we will ask your employer for a statement. We will issue a written decision containing appeal rights.
You will file weekly claims by touch-tone phone on our Telephone Information and Payment System (Weekly). You can also use the Weekly System to get information on the status of your claim. Benefits may be delayed or denied if you do not file each week. The policy booklet explains how to file your weekly claim.
All unemployment insurance benefits are taxable. You may elect to have federal income tax withheld from your benefits at a rate of 10 percent. You may change this option at any time.
You must report all wages when earned, not when paid. Employers are required to report all wages paid to you. Our computer matches claims with wage reports to find out who worked while receiving benefits. We also have agreements with other states to discover if anyone was working while receiving unemployment insurance benefits from Tennessee.
There are severe penalties for misrepresenting information to obtain or increase benefits. The law requires that you answer all questions truthfully and permits this agency to prosecute individuals for making false statements. You will be forced to repay all money obtained under false pretenses, and you may be disqualified from receiving future benefits. In addition, you may be fined or imprisoned.
After you file your claim, we will mail you a packet containing your Policy Booklet. It explains your rights in regard to your claim and your responsibilities when filing. It is your responsibility to read the booklet. It includes information on how to file your weekly claim, how to change your address or IRS deduction and other important information. If you do not receive the packet within 7 days, contact your local office.
