so parago says a rebate check has been cashed, but i never received it

sigh. hello. bought a western digital hard drive from officemax.com photocopied everything. didn't receive check so i called in. they say it was cashed weeks ago. i'm positive i never received it. but i double checked by bank statements, which confirmed that i never cashed it.

and now parago is not willing to do anything besides tell me that it was cashed weeks ago. they repeat this to me no matter what i say. i explained it could be fraud, or that they could just be scamming me. but they say they can't trace the check.

this happen to anyone before? i hope they didn't just scam me out of $50. or that a mailman/neighbor has an extra $50 and will get away with this.

i live in california

what to do?

EDIT: the rebate was to be paid by western digital, if that makes a difference
 
I would take all documents down to the store you bought it from, ask to speak to the manager, and explain the situation.

i bought stuff from online store. would store manager be able to help or is store and online different entities?



is there anyway to speak to a higher up person from parago, anyone have contact info? i spoke with initial drone, and then asked for her manager who did nothing.

Ignore Parago speak with BB manager. Rebate companies are almost as bad as insurance companies...Deny all claims and hope they don't follow up.
 
File a complaint with the BBB, then contact your state AG (Attny Gen).... If you have some time to invest, file a suit in small-claims court against them. You wouldn't need a lawyer, just copies of everything you sent in. They'd then have to prove that you cashed the check, which they cannot do, so you'd win the $50, plus filing fees.

who do i file against? it was bought from officemax.com, processed by parago, and to be paid by western digital, and i live in california. could i just put the name of local office max manager?

also it doesn't matter to small claims court that someone else supposedly cashed it right? even if they show up with the check being cashed by joe neighbor, that's got nothing to do with me right?

 
You would file a claim against Parago, they are the legal entity processing the request, and they are the ones responsible for the payment of the rebate for that offer. As long as you're not the one who cashed the check, you should win, especially if you have proof that they accepted the rebate materials as "complete" and sent out the check. Essentially, that proves that you've completed your portion of the "contract". They then have to prove that they completed their part of the contract, getting the check to you. Of course since you never got the check, they can't prove that they did so - it should be open and shut. File a small claims suit, it's a little effort, but it's interesting to see how that stuff works (and it really does work).
