They moved out in the middle of the month. No formal lease was signed for them, but they paid rent and utilities and were okay about it until the last few months.

She went to go collect half's month worth of utilities (the utility bill divided by three, then divided by two) and one of her former room mates freaked out and said he didn't have to pay that and it was bull shit that he had to pay for it.

Granted, he called back and apologized for being an asshole. But...I think it is only fair to pay her REGARDLESS that they didn't have a formal lease. You live there, you pay the bills -- simple as that.

The nerve of some people amazes me.

Take it as a lesson learned and next time have them sign a lease.

I had one of my previous roomates do the same thing. Lived in the house a couple of weeks past the lease (which wasn't a problem) but refused to pay part of the bills when they came.

Fuck that guy.

Even if you don't have a lease, you still HAVE to have a deposit. Take the utility money out of that.

If there was no deposit, chalk it up as a lesson learned.

Small claims.

If she can prove that they were paying 1/3 of the utilities each month, then she may have a shot.

Verbal leases are just as valid as written ones, just harder to prove.

she got paid, no issue here. Im not sure why theirs even a thread about it considering they paid. OP is just blowing off some steam, Nothing wrong with that.

What happened was the billing period for electricity was the 15th to the 16th of the next month.

So, they moved out on July 31st, but still had July 16th to July 31st to pay for. Sounds kind of shitty for them, but really it is only fair. She shouldn't have to pay a massive electricity bill just because they moved out on the 31st.

I guess I should rephrase..they haven't really paid her yet, but apparently their checks are in the mail.

I was just really suprised because one of the guys living with her was seemingly a nice guy, but towards the end of his stay there he became real passive aggressive. He wouldn't say anything to anyone and just shut himself in. He was late on payments and then he got pissed at her for asking for a final payment.

This is not that bad of a deal for him considering he left his room a hell hole and didn't help to clean anything out. He didn't pay for damages either.

I reviewed the small claims stuff for Nebraska and after talking with a lawyer, we have a very strong case against him if he doesn't pay up.
