Since it's the other driver's fault, you're not entitled to fork anything out of your own pocket. So, you can either claim with your insurance and have your insurance do the dirty work to get the money back, or deal directly with the other driver's insurance.

If you don't have rental insurance, then you have to put money out of your own pocket and recupe that from the other insurance.

Or, do what everyone does - sue the bastard.
 
I think there may have been another driver involved in this accident now. After I informed my Dad about the accident, he went to the scene and saw a red vehicle that had a damaged front end. So, he thinks that the red vehicle hit the SUV, causing the SUV's driver to lose control and ultimately hit me. Does this affect who is at fault in this case? Is the SUV driver liable for the damages caused to my car even though she lost control because of an accident with someone else.
