so I missed Jury Duty

so I'll admit I missed it prolly my fault, but I never really check my mail, nothing important comes in there that I need, all bills I ahve are autmatic or atleast handled thru email, but was going thru some past mail to find an old pay stub because there was a dispute over some sick time with my job and relized last month I got a jury summons.

How can they really prove you got it if it doesn't come certified mail? I mean you can't force someoen to apear in court with certified mail why can they just assume a pretty non discript envelope is enough to show you know you need to apear.

also in the mail was another letter saying that I missed jury time and need to respond within 14 days which was yesterday. should I just call today?

They are going to issue a bench warrant and you will be taken to jail where you will get raped. Sucks for you.

As I understand it, by law all mail is presumed to be successfully delivered (sorry don't have a link). But you admit you got the letter anyway so that point is moot :)

Call them, tell them you missed the letter and would like to reschedule. It shouldn't be a problem...but make sure you take action, depending on jurisdiction you may have a bench warrant right now.

A summons is an official court order compelling you to appear for service. The Court does understand that every juror has personal or professional obligations that may make jury duty a difficult task to manage. However, jury duty is not an optional experience. If you are selected by the random computer process, you are required to report as scheduled. There are no categories of employment that result in automatic deferral or excusal.

Failure to Report for Jury Service
If a juror fails to appear for the assigned service date and fails to call to reschedule within 14 days, show cause proceedings for contempt of court will be initiated. Failure to report to a show cause hearing will result in a bench warrant for arrest. Jurors may be fined and/or jailed if found in contempt of court.

When I was younger I never bothered to respond and just chucked the letters. Nothing ever happened. These past 5 years I started phoning in and registering but never get called in either. I even missed the initial summons letter but called in when I received the follow up letter and they just rescheduled me.

Usually all legal documents are sent via certified mail. So I don't see how a document sent non certified mail could be deemed as delivered. However judges have a lot of leeway and can make life difficult for you. I would just call them and say you haven't checked your mail in a while and just found th summons and the followup e-mail. I would then ask to re-schedule. Usually they have so much other stuff going on they will be happy to reschedule.

Theoretically yes. In reality it depends on the jurisdiction. I know that where I live (Baltimore) people ignore summonses all the time. 99% of the time nothing happens, but every now and then a judge throws a hissy fit and issues some warrants.

What some people do is show up for jury duty, register, collect their jury pay and then leave. Those people ALWAYS get bench warrants.

You see if you call and you say you never saw the letters... the court will ask you why you were calling if you didn't know you had to report for jury duty.

Yeh you are screwed.

If they have plenty in the jury pool (which they always do if it is a large city), then nothing will happen.
If you are in a small town and they send out requests without many spare, you might piss them off.
