well, a couple days ago i was browsing craigslist and found a guy selling a nokia n95 for $500 obo. i emailed him and got him down to $300. talked on the phone and the guy seemed legit! then after we met up and i got the phone, i was in such a hurry i didnt check it out till about 20 minutes after we met up. at which point i realized its a FAKE:

so naturally the guy wouldnt answer his phone after i bought the goods. so i started emailing him from a random email addy in the form of a buyer, and today my friend met him to buy a phone and i pulled up shortly after blocking the guy in from leaving, and basically told him you skrewed me over, i want my $$$ back NOW. he didnt have any $$$, nor an atm card..so he wanted to give me a phone as hostage, i made him give me two (so i have a total of 3) and he said he'd call me up when he gets the cash today. i also brought a camera and took a picture of his license, and the dumbass himself:

so, he just called my friend up and told him he has the cash.
now, im deciding what i want to do..even though they're clones i could probably reselll them for $150-200 a piece (they work, have touchscreen, take video, play music, camera all that crap), or i could meet him up and get my $$$ (+ ill ask for $100 of interest, for wasting so much time getting my $$$ back)...my dads saying since they're clones they're illegal and i cant sell them, even if i disclose they're clones. also if i meet the guy up it better be at a public place like a mall, so his buddies couldnt roll up and try to jump me!

anyways, this is my story - what are everyones thoughs of this? what should i do?

Looks like a great guy.

It is illegal to sell knock-offs.

Meet up with the guy in a public place with a few friends and exchange phones for money.

also op, what does it not do that the n95 does?

gps
5mp camera
slide both ways for mp3 playback
good quality screen
good feel of a phone (it feels and looks cheap)
oh, and i forgot to mention it doesnt even get a signal anywhere

one thing i am pleased with, is the speaker is loud as hell, but since the phone is a POS it doesnt really do any good

Like those fake iPhones and PSPs from CHina? They still have some features but are obviously fake? I thought u meant u bought a dummy phone at first...

These are still worth $100? - $150? I remember selling my K750i for $200 or something a year or so back. I would take a K750i over that fake N95 anyday. I can't believe it's actually worth a decent amount still..

Listen to daddy. Just turn the dude in or get your money back in a public place with your own thugs with you. Otherwise, "If you're going by yourself, wear a helmet." And tape your insurance/health card to the soles of your feet. They'll probably take your shoes for fun...

your dad is right. you can not put them back up for sale.

just get your money back. asking for an extra $100 is not a good idea.

I'd think he'd be looking to jump/stab/shoot you.

I'd bring along the police or have him get you the money by a means that doesn't involve the possibility of an ambush.

honestly, i dont think an extra $100 is unfair for allt he time iv put into trying to meet up with this bonehead.

actually, perhaps i should just meet up with the basterd and bring the police along?

I was hoping you'd get your phone back. But you want to turn around and sell the things your pissed off at being sold to you in the first place? Regardless if you told the customer its both stupid and illegal.

Now I can't say I care whether or not you get screwed.

Drive to a public place with several friends.
Have 1 friend (with camera/videocamera?)stay in a car in plain sight (leave all your valuables with him/her)
Walk to specified location with several friends(make sure no one sees you walking from the car)
Have friends pretend to be customers walking around...sitting/standing in patio of stores/restaurants
Then trade phones for $.

Wait for him to leave....then you leave?

Something like that.

Oh, your life > $100

iv decided i wasted enough time on this
im just going to take my $$$, give him back his crap and be done with it.. i dont need to make any enamies, or waste any time with the police

Be glad you're getting your money back. Personally, I'd be trying to have a cop there for the exchange...fcking scammers need to go to FPMITA prison for their bullsh!t, but it sounds like you're scared of the guy...so IF you get your $$ back...be glad.

These fake N95s are VERY common on ebay. You really DO need to check pictures closely before buying a "cheap" phone. No one sells Nokia phones all that cheap!

These fakes actually run Windows Mobile, and apart from being no where near the same spec as the N95 are not actually bad phones (per-say)

However - if the guy sold you this phone AS an Nokia N95, then he was commiting fraud, as this phone is NOT a Nokia N95. The solution is simple - take the police along. Do NOT try to resell them, as then you're dropping down to his level!

You're asking for more than what you paid? Are you threatening him in someway to get extra money? That would be extortion, which is illegal. Don't do that. You can go to jail for that.

And yeah, the phone is a fake, but it is harly apparrent by the logo. You have to compare the buttons and placements. It would have been helpful if the OP had explained how he knows it's a fake.
