Smart Gart keeps turning my AGP off

I just did a fresh reinstall of windows and now my ati drivers are acting strange. I installed 4.9.

Usually, reinstalling your mobo's chipset drivers and possibly DX9 corrects this. If AGP texture acceleration is diabled in DXDIAG, then you def need to reinstall mobo drivers.
