i thought i was helping a friend but they turned out to be a real ass. now i am thinking of going to small claims go for 999.00 and demand my pc back

On April 21, 2007 I was asked by XXXX XXXXXXXX to come out and look at his business?s (XXXXXXXXX XXXXXX) pc due to it wouldn?t power on. I was to be paid for travel up to said business. I brought along a test pc to see if I needed to test parts. I arrived and parked along side of his business at about 10am and went inside to work on the pc. I found out that the cpu was not reading correctly and that the motherboard fan sensor was saying it was not connected. So I was then asked to set mine up to get them online so they could pull images off the internet for tattoos. It took me about 8 hours to get everything installed and setup. During which I did advise XXXX he should invest in a new pc as this was only a temporary fix.

During this time while I was working on the pc , XXXX?s wife XXXXX co-owner of said business was using a blower to blow rocks and dirt from the front of the store. Also XXXX had one of the shop mechanic?s son, throwing dirt into the pot holes around the business. Trying to fill them up but he had to stop once he threw a bunch of debris that splashed up on the vehicles in the lot. Mine being one of them.

When I finished installing the pc I loaded up my stuff and got into my car when I noticed a inch long ding on the front of my windshield and other minor dings going across my windshield which was not there when I arrived. I then told XXXX about this and he said he couldn?t see how it was done , I explained it wasn?t there when I arrived and it was in my line of sight so it would have been noticeable and was going to need to be replaced. On the way home the vibrations from the road and wind from driving on the freeway cracked it more and it has to be replaced and i have to leave my car in the parking lot because i have to work

I told him I would check with my insurance to see what it would cost to get fixed, and he said sure. I found out that it would be a 250.00 deductible and when I told XXXX the next day he was adamant that it wasn?t caused by them and that he wasn?t going to pay to get it fixed. And I was never paid for my time or services to come out to fix the pc.

Don't call him. E-mail him. He can say anything over the phone but lie in court. After he admits he has not paid or given a reason why. Send him a bill for services by certified letter. The letter should be a invoice, make one with Word, and have it say bill is due in 15 days from mailing. If he does not pay then file a small claims action and take e-mails and certified letter to court.

As far as damages to your car he can say it was like that before. In court the burden of proof is on you not him. So unless you have a witness or the person doing the cleaning up admits they did something I really doubt you will win. So don;t bring it up at all if you go to court. Stick to what you can prove and nothing else. I don;t care what else he has said or done. Stick to what you can prove.

OK prove it was them that did it? remember in court you have to REALLY prove your case. That is why you need something that proves you did work for him. If you go to court and you say yes you did work and he says no then it is a he said he said. Same with the car damage. Can you REALLY prove it was them that caused it? Very unlikely. Not trying to be mean, but that is how courts work. Theres a reason why most plaintiffs lose.

good luck w/ that- I took a girl to small claims for about $400- she just took off and didnt pay anything. Even if she stuck around, forcing her to pay would not have been easy...tons more paper work etc to get anywhere near garnishing her wages. It was a real mess when I went though it here in Seattle.
But the actual trial was cool- I nailed her ass...I knew I had her so it was fun to have the judge make her look stupid =)

8 hours, and you never asked for compensation? You screwed yourself by agreeing to work for free to begin with. I bet that guy isn't in business b/c he gives away free crap all day.

What type of job took 8 hours?

it was helping a friend but now hes not. i shoulda just said no. . but hes pissed me off for the last time.

i guess im slow but he'll see how slow i am when his wife finds out
