Lets say a legitimate business is established in one state and registers a domain name of www.gadgets.com and sells stuff on line as well as though their physical store.

Another company in another state but in the same business sells gadgets as well and registers www.gadgetsonline.com (or something similar)

Lets say in this example both companies have been in business for 20 years.

Can either of them go after the other for the domain naming rights?

Something in this case you would think favored the computer seller, yet Nissan got judgements in their favor for a while.
