Unfortunately. They all say "the limit is too low"... well we live in a democracy so if their concerns are founded then they will have more than enough people who agree with them and they should get their government to change the limit.

Wether you agree with the laws or not, as a citizen you are required to follow the rules. If you don't agree with the rules, try to get them changed. Don't start b!tching or complaining when you get a ticket though.

Breaking the speed limit by a certain amount is automatically reckless driving. That amount depends on the state and what the posted limit is.

At least in my state, I believe there are other factors that need to be met for reckless...other than speeding. I'm sure that if you were going like 150 or something, you would probably be fvcked though.

In Virginia, 80 or more in a 65 and 60 or more in a 35 is an instant reckless driving. I don't know of any states that absolutely require other criteria to be met, but I suppose its possible.

I'm pretty sure it is at the discretion of the cop. The Virginia law says anything in excess of 20 over the speed limit or greater than 80 MPH can be charged as reckless driving. It all depends on what they write on the ticket.

No, if the cop writes down the magic number (or higher) on your ticket/court summons, its reckless. You CANNOT prepay the ticket and MUST go to court.

The only things that are at the cop's discretion are:
a) Whether he writes you up at all - but if you're going more than 15 over, they usually do.
b) Whether he knocks off a few MPH so its no longer reckless - which they usually do if you were only a few MPH over and are polite to them.
c) Whether or not he arrests you on the spot, which, by the way, he is authorized to do at his own discretion when pulling someone over for reckless driving.

It is not the number, it is the statute he charges you with violating that determines whether it is reckless. I have had tickets here at 20 over and not been charged with reckless driving. If it is different then they must have changed it in the last year and a half.

If that's true, you'd be the first person I've ever heard of getting away with it in this state. Of course, I've only lived here for 2 years thus far.
