Hate to say it bud,but she kind of deserves a ticket for not waiting until the road was clear before pulling into oncoming traffic. Be glad all she got was a ticket and didn't get killed.

Maybe she can get the ticket reduced as some others have mentioned. Worst that can happen is the judge makes her pay the full ticket price. Might as well take it to court to see anyway.

I am glad to hear that she is alright and that she didn't have any serious injuries.

As far as the accident is concerned, it was her fault.

I had a somewhat similar incident happen to me, in which I pulled out into traffic, was preoccupied and failed to see a pick-up truck heading towards me at about 60 mph. The truck hit the right side of the minivan i was driving, the van did about two 360's and flipped over. Luckily, I was not injured and neither was the driver of the pick-up truck- but I did receive the ticket. It was clearly my fault, and whether or not I saw or didn't see the truck had nothing to do with it.

Obviously the Expedition did add stress to the situation, but the police and the judge you face in court will exclude this externality in the account of the accident. I would suggest she pay the ticket, calm down, search for a new vehicle, and be more careful when on the road.

OMG! is she ok? ... that picture looks horrible! i dont know about fighting or not fighting, but thank god she is ok.

I dont see how you are going to fight and SUCCESSFYLLY DEFEND A TICKET WITH A HIGHWAY PATROL. Unless you have time and money to waste!!!

I did the same thing on July 10th. I turned left and didn't see the oncoming truck because there was a car tuning and blocking my view. Anyway, I totalled my 2000 Accord and received a ticket also. I am in the process of attending online traffic school and getting that cleared. My insurance covered my fees since I had comprehensive coverage and that's that. I was cut a check for 17K and purchased a 2001 Accord. Oh yea, my insurance is up now from $130/month to $220/month. That is a unmarried, male, 6-8 years of driving experience, using a car for "pleasure" driving, with an annual usage of less than 7501 miles. I supposedly get discounts for being a good student, having multiple cars, and being a homeowner. I don't know how I got all of that, but I'll take it if it saves me some money.
