What if you buy a drink, finish it yourself, refill it to go, drink half of it, and then say to your wife "I'm not thirsty anymore, do you want to finish this drink?"

There is no difference. Somewhat on the grey scale for this specific issue only but still perfectly legal and you are fine if you do this at any fast food restaurant.

Not when you get and take advantage of free refills. Read the OP. If I take in 20 people and buy one small drink to hydrate them all, you can see the problem, right? Good.

That said, I only *avoid" sharing with my brother before leaving. Typically, one of us will drink as much as he wants while there and the other will have the refill when we leave. If the other one of us needs a swig to help swallow something or because the food is too dry, he is welcome to it even before we leave.

When I lived in San Diego with my motorcycle as my only transportation I routinely transferred containers before leaving so I could take my refill in my tank bag. I would usually empty my refill from their cup and into a wide-mouth bottle outside after I had already left with what was rightfully mine to do with as I pleased, but some times it was raining or something and I wouldn't bother waiting until I was outside. No one ever had a problem with that either.

He didn't do either of those. First off the police wouldn't have bothered with him. If McD's had a problem with this, which they and other fast food restaurants are aware this happens, there would be a sign stating such a policy when you purchase.

While this is a completely comprehensible post, I had to read it about seven times before my brain quit trying to have a stroke.

Why? It was a pretty simple sentence. I don't live in the US so I have no idea what taco bells policies are. That said it sounded like he was trying to compare a normal meal with an all you can eat or drink scenario.

In general, all fast food places in the US allow free personal drink refills during the same visit you purchased the drink. Many have the fountain in the dining area for self service but all you have to do is go back to the counter and ask for a refill if they are behind the counter.

Free refills, so not theft it would seem. Although pretty dumb anyway.

AFAIK in the early 00's it was all of like 10cents for a 20oz fountain soda fill (which is why they don't care) so these days maybe 25-30cents tops.

They don't care.

If the cashier took 5 minutes to yell at you they probably lost more money than just letting you drink it.

Ever go to fast food places in sketchy places? They all have the drink machine behind the counter. Shit like this is why. Its a pittance, but its still stealing. If whatever food you're buying is priced per unit, share all you want. Unlimited is priced per person, don't share. (or don't take advantage of the refills. Get a large instead of two mediums if you like.)

To those who say this is theft, I would ask: is sharing a tub of popcorn and getting a free refill at the theater theft also?

Theft would be defined by the business selling the product and their policies.

In my experience, I have had movie theater employees tell me specifically do do exactly what you describe as part of their sales pitch to buy the large refillable size. In fact, on more than one occasion, I had a theater employee mention that I should request a box (like they put hot dogs and other items in) then pour the popcorn into the box from the tub and give that to the person I was with, then get an immediate refill.

However McDs has no such policy and their refillable drinks are only for the consumption of the original purchaser. So, in the McDs case, it is clearly theft. Not a big deal to be sure but still theft.
