1 free month. I just got the notice today in my email. I think if you don't have the same email that you used when you had netflix you may not get the notice. I hope they do a snail mail version so that they try to get everyone.

What a lame settlement. You got crappy service from a company....lets give them a free month!!!

I personally quit netflix awhile back....I got the email though. I'm in TN.

i got the email and i'm in NY. it's for everyone.

i'm not interested in the settlement terms. i canceled in 2003 and haven't looked back.

I got my e-mail today too.. i signed up. I'll probly get a free month and rob them by reporting the discs never recieved.. I hated Netflix.. they always had 5-6 day turnaround .. bastards! Blockbuster rocks.!

I can really say that the consumer got screwed in this "settlement" (if you can even call it that), Netflix is going to boaster their own profit margins with this ploy. They are wanting their consumers to upgrade their accounts (and forget to downgrade), thus raking in more dough for them. I doubt most people have actually bothered to read the fine print.

"Settlement Agreement"

The Fine Print
Netflix shall be permitted to automatically renew the upgraded service at the end of the upgraded month at Netflix's regular subscription rate for the upgraded program, unless and until the Class Member cancels the service or modifies his or her subscription.

No less than four (4) nor more than seven (7) days before the end of the Class Benefit for each Class Member, Netflix will send an email to the Class Memebr reminding the Class Member that he or she may elect not to renew the service at the benefit level.
I have emails lost (or thrown away by Spam Filters) all the time, I sure would hope this wouldn't be one of them. Even with this email, I doubt 50% of the members will bother to downgrade, maybe its time to grab some stock!

EDIT: BTW, I have used Netflix for the last year or so, and definitely have no complaints. 3 day turnaround (I live out in the sticks, snail can not be expected to be super fast) so I always have at least 1 movie waiting to be watched. Maybe I'm a special case, but the service has been excellent for me. I have a 42" plasma, but don't want to spend money on Satelite since there is never anything good on anyways. So thus I get Fox and ABC on my bunny ears, and watch a new movie (or an old one) everynight when I get home from work.

I read the fine print and laughed thinking "wow what a cheap advertising ploy for Netflix, and what a CHEESY way to get probably THOUSANDS of people to upgrade". No thanks I'll pass on this one.

Got my email too. I think it may be a trap and if you don't cancel within that month you will be automatically re-subscribed. I'll wait and see. Some settlement....pfft!

Wow, some of you can complain about anything. Is it that hard to remember to downgrade/cancel before the subscription is renewed? Remember, they are either upgrading your service or giving you a free month.

They are going away unless they go to movie downloads which seems to be the next trend.

I got the email too, and let me make sure I'm understanding..

You can't sign up for the free month yet, correct? You can resign up now and they'll credit you the month once the settlement gets signed, or you can just wait for that and then resign and get the free month right away??

Dido..me too. At first they got me the movies fast, then as time went on the movies were lucky to get to me in a week! Sucks!

As usual, original "plaintiff" gets $2000, class gets nada, and attorney walks away with $2.5M+.

Also, be advised that the small print says that you agree to pay the extra costs of the upgrade service after the one month UNLESS you OPT OUT when they send you an email later on...

same, used to be ok. 2 days turn around, never one day. then it started to become 4-5 days.

I'm not dissatisfied with Netflix, I'm on the 8 movies at a time plan and watch 30-40 dvd's per month, that's not bad for the money spent at all. But I just laughed at this settlement, one month free of the "next bigger plan" then if you DO NOT cancel that upgrade you stay on the new plan. Hell they'd probably give you that anytime you asked for it, it's hardly a "punishment" of any sort...

Netflix will probably make 2x to 3x the settlement money up in the fees by those who forget to cancel their plan after the month.

I dunno. If you can find 18 movies that are worth watching, there MAY be a problem,.
