I put an item up for sale (not on anandtech) and was contacted by a potential buyer. After a few PM's to get more details on the item the buyer said he wanted my paypal address and he would pay ASAP. That was a little over 24 hours ago.

Meanwhile, I was also contacted by another person that is interested. I PM'ed the original "buyer" and told him I'd give him until tomorrow morning (~36 hours after he accepted the sale and told me he'd paypal ASAP) but then I'd have to take other offers.

Does that sound fair?

need more info. did the original guy tell you when he would pay? if the original guy wants to buy and you seem confident that he will pay, i'd wait. I'd be a little pissed if you sold it the other guy after I told you i was going to buy it.

unless you need this money for emergency life saving brain surgery, then don't be greedy.

He just said ASAP.

At 5:35 PM EST on Sunday (yesterday) he PM'ed me:

Good deal. I'll take it. Send me your PayPal and I will send the funds (plus the extra to make it XXXX) ASAP. Thanks!

I sent him a PM today 9:46AM just mentioning that i never received anything and that I wanted to make sure he didn't accidental type in the wrong paypal address.

I also updated the thread in case he doesn't get PM email notifications.

I'm in no huge hurry but I also don't want to wait forever.

Remind me never to trade with you. There is a unwritten code of etiquette you should follow. Now if someone is just jerking you around, then move on to the next potential buyer by all means, but give the first guy a chance to pay. I would say no contact after 36 hours would be a fair sign to move on.

You want legal advice?

An offer to form a unilateral contract invites acceptance only by full performance; merely promising to perform does not constitute acceptance. Unless the offeree had to change his position because of a justifiable reliance on the offer. Since there was no partial performance made by the offeree, nor was there any justifiable reliance made, you can revoke the contract at anytime.

You revoked the original offer and made a counter-offer and entered into what they call an option contract. As in you give up your right to revoke for the specified amount of time.

If you want my down to earth advice? Every offer you make from here on out, make sure you specify specific terms before the sale.

I'd say 24 hours with no word from the "ASAP" guy would be enough of a reason to pass. If he sent you some money, even a $1 through Paypal, then I'd say hold it for longer. Etiquette goes both ways.

24 hours does not constitute "ASAP". "ASAP", to me, mean "within the next couple of hours". However, if you have the guy's email, email him.

Can you tell if he's logged on within the past 40+ hours?

Money in my paypal account counts for dibbs, don't worry about being fair. Some people think a PM is the end-all to complete a deal.

Did you agree to hold it for him? If you didn't then go ahead and sell it off to someone else. It's not like you have a contract or anything. What's he going to do if you sell it to someone who paid first, pout?
