Selling a car that belongs to someone else. Need advice.

Hi,

I'm a newbie when it comes to selling vehicle(s) so I need some advice. My brother's been driving a truck that belongs to my mom (title and registration is under her name) for quite a while now. He wants to buy a new car and we've received permission from my mom to go ahead and sell the truck. The problem is that my mom is some 400 miles away from where I live (my brother lives with me). She has the title and I've requested her to send the title over so we can provide proof of ownership to potential buyers. Do I need to have her transfer the title to my brother's name first? And if so, what more does he have to do to take ownership besides paying a small transfer title fee? Registration? Smog check? The plates are good until 6/30/2013. If the title doesn't transfer to his name, can we still sell it?

This is in the state of CA by the way. Many thanks in advance.
 
Just have her sign off on the title releasing her liability before she sends it to you.

Your mom only needs to sign the title and then send it to your brother. It is legally owned at that point to whomever has the title in their possession.
