Second hand smoke from neighbor. What are my options? (Cali.)

Hi. My downstairs neighbor sits on his balcony and smokes all day. If I try to air out my room, I get second hand smoke coming into my apartment.
I told him about it, and he said, well I can't do anything about that, talk to the manager.
I think he has a kid, so I don't want to tell him to keep it indoors, but this is not working. I either close all my windows and my apt gets stuffy, or I have second hand smoke coming in. I guess I am gonna tell the manager on monday when I pay my rent. But what are my options with regard to this? Can I withhold rent until this is addressed, because it goes to the habitability of the apartment. I am gonna move in a couple months regardless, but in the meantime it would be good to get some fresh air.

I don't know what the landlord is supposed to do in this situation, which is why I am asking? The backup plan is always to move out. But it's a lot of hassle that I would rather avoid.

there isn't a thing you can do about it.

he rents an appartment and has the right to smoke on his balcony if he wants. put a fan in the window blowing out and suck it up. or you could make a post over at hard forums.. they might care.

Open up a window in the front of your apartment, that will suck air in from the front, and blow it out the back, keeping the smoke from seeping into your apartment.

I only have windows on one side. So my bedroom window is a little further from where he smokes, so I'll try keeping those windows open. It still smells a little there, but not as bad as my balcony door. Anyways, I'll talk to the manager tomorrow. I will probably move out in 2 months anyways. I don't want to be the smoke police.

Get some CHEAP perfume and spray it down to him when he smokes.
When he is inside, make noise (sound travels down). Unless he's an idiot, he'll eventually figure it out.

Unfortunately, some smokers are extremely self-centered and ruin it for all the others. They couldn't care less about anybody else's comfort. It was the same when they could smoke in restraunts and the smoke stream would go right into someone's face. A courteous smoker wouldn't let that happen, or would be accomodating if it were a problem.

Comes down to common courtesy. Some people will never understand that, and that's why nobody wants to be around them except others like themselves.

when im around people who smoke.. i just get the urge to smoke even though i shouldn't , so i carry around clove cigarettes (djarums)
Anyone else like clove ciggys?

That is true. Just like he has a "right" to smoke on his balcony, I have a "right" to walk in my apartment. So far I've been considerate and walked softly. But I guess that will change.

Good point, except that cig smoke STINKS like none other.

I would ask the apt manager if you can change apt rooms. Maybe move to another opening they have or something.
 

It's really hard to post in this tread without opening flaming you.

There realistically isn't much you can do but move.

one time I was in a restaraunt and the table next to me had a guy who was chain smoking. I asked him if he could at least slow down. He basically got snotty with me and told me to fok off, and started blowing smoke towards me. So I took my glass of water and poored it in his lap. Then I said, I still don't think you are as uncomfortable and irritated as I was with your smoke.

He got pissed and told the manager. By that time I was done with my meal, and then refused to pay because it was ruined by the smoke. I walked without paying.
