It was a flight out of Hawaii and I belive the person w/o a seatbelt was a flight attendant.

And Daniel, the reason your seatback has to be in the upright position for takeoff and landing is so that, if an evacuation were necessary, your seat isn't blocking the egress of those seated in the row behind you. Edit: This is why the seats in the row in front of an emergency exit do not recline at all. You don't want to sit there!
